                     Hannah Burk Exrx of The Last will and testam.t of Tobias
Burk Late of Somersett County Planter dec.d was attached to answer unto
Thomas Dashiell of a plea of trespass upon the Case &c

                                     And whereupon the Same Thomas Dashiell by Levin Gale his attorney
Complaines that whereas the afd Tobias in his Life time the first day of aprill one thousand
Seven hundred and twenty Six at Somersett County afd within the Jurisdiction of this Court was Indebted
to the Same Thomas in the Sum of two thousand Nine hundred and forty Six pounds of
tobacco and one pound Nineteen Shillings and Nine pence Currt Mony and so thereof being Indebted
the said Tobias in his Life time afterwards to witt the same day and year afd at the
County afd and within the afd Jurisdiction in Consideration thereof upon himselfe assumed and to
the Same Thomas then and there faithfully promised that he when afterwards he Should
thereto be Requested he the afd Sum of two thousand Nine hundred and forty Six pounds of
tobacco and One pound Nineteen Shillings and Nine pence Currt Mony to the Same Thomas
would well and faithfully Content and pay Nevertheless the said Tobias in his Life time and the
afd Hannah Since the death of the said Tobias the promise and assumption afd of the afd
Tobias in his Life time so as afd made Little Regarding and Plotting and fraudulently
Intending the same Thomas in this part to defraud and deceive Neither the afd Tobias in his
Life time nor the afd Hannah Burk Since the death of the said Tobias to whome Execution
of the Last will and testam.t of the same Tobias was in due form of Law Committed the afd
Sum of two thousand Nine hundred and forty Six pounds of tobacco and one pound Nineteen
Shillings and Nine pence Currt Mony hath not paid or the said Thomas for it in any wise
Satisfied altho' the Said Tobias in his Life time afterwards (viz.t) the tenth day of June
Ann Dom One thousand Seven hundred and twenty Six and the afd Hannah since the
death of the said Tobias the tenth day of aprill one thousand Seven hundred & twenty
Eight at Somersett County afd within the afd Jurisdiction by the afd Thomas were thereto
Requested but they and Each of them the Same hittherto to pay or the Same Thomas for it
in any wise to Content have altogether Refused and the said Hannah the same to Do Still
doth Refuse whereby the same Thomas says he is worse and hath Damage to the
Value of five thousand Eight hundred and Ninety two pounds of tobacco and three
pounds Nineteen Shillings and Six pence Currt Mony and thereof he Brings this
Suite &c                                          Levin Gale P Quer Pledges &.c  Jno Doe R Roe
