1728 122 hands of any Other person) if they Shall be found in your Bailywick to the Value of fifteen hundred pounds of tobacco and when you have the same attached or any part thereof the same in your Custody safe Keep so that you have the same before the Justices of our County Court of Somersett to be held at dividing Creek the third tuesday of August next then and there to be Condemned According to Law to Satisfie unto Thomas Dashiell of twelve hundred and Eighty Six pounds of tobacco which to the same Thomas Dashiell in Our Court before Our Justices at dividing Creek afd were adjudged for his damages which he had by Occasion of a Certain promise and assumption to the same Thomas by the afd Edward in his Lifetime made and not Performed &.c and that by Good and Lawfull men of your Bailywick you make Known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before the Justices of Our County Court to be held as afd to shew Cause if any he she or they have why the Same goods or Chattells Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made According to the form of the Act of Assembly in Such Case made and provided if to him her or them it Shall seem mete and how you Shall Execute this Writt that you make known unto our Said Justices at the day and place afd and have you then and there this writt wittness Saml Hopkins Gent Chiefe Justice of our said Court the twentieth day of June in the thirteenth year of our Dominion &c Att which said third toes tuesday of August to witt the twentieth day of the same Month Ann.o Dom One thousand Seven hundred and twenty Eight Comes the said Thomas Dashiell by his attorney afd and the Sherr of Somersett County to whome the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt Attached full value in the hands of Ralph Milbourn John White and Archabald White and Sumoned as Garneyshee P Fran Allen sherr Whereupon the afd John White and Archibald White Garnishees as afd in their Own proper persons appears and the said John White says that he Cannot Gainsay but that he hath of the Rights and Creditts of the afd Jno M (Jno Murrow wh Executor of Hugh Porter who was Executor of) Edward Bray ^to^ One Case of Pistolls and holsters and and raiper And the afd Archibald White garnishee as afd says that he Cannot gainsay but that he has of the Rights and Creditts of the afd (Jno Murrow Executor of Hugh Porter who was Executor of the afd) Edward Bray ^to^ One Case of Pistolls and holsters and Silver hilted Raiper nor Can they say but that the same Ought to be Condemned in their hands as of the Rights and Creditts of the afd (Jno Murrow who was Executor ^of Hugh Porter^ who was Executor of |
