121 Whereupon the afd John Caldwell present here in Court in his proper person acknowledged himselfe to Owe and Stand Justly Indebted unto unto his Lordship the Right honrble the Lord proprietary in in the sum of five pounds Sterling good and Lawfull mony of England of his goods and Chattells Lands or tenements to be made and Levied for the Use of his said Lordship his heirs and Successors if default be made in the Condition hereunder written The Condition of the above Recognizance is Such that if the above bounden John Caldwell do make his personall appearance before the Justices of his Lordships County Court of Somersett ^to be held at dividing Creek^ the third tuesday of November Next and do then and there give Evidence against the afd Elianor Haines on behalfe of his Lordship and doe not depart the same Court without Lycence thereof &.c than the above Recognizance to be void &c otherwise &c Dorothy Crouch appears and discharged from her Recognizance paying her fees &c Arthur Warwick Executor of W.m Warwick appears to ^Sumons for^ Ballance of said William Warwicks Estate and produceth receipts that he had paid of all the Estate and is discharged &c
Travers may give Speciall bail to the action afd Thereupon a Certain Nicholas Ready of Somersett County Planter present herein Court in his proper person undertakes for the Said Henry Travers that if in Case the afd francis Allen Shall Recover Jugm.t in the plea afd against the afd Henry Travers or that the afd Henry Travers Should be there in Convict that then he the said Henry Travers shall pay the Condemnation of the Court thereupon or Render his body to the Custody of the Sherr of Somersett County in Satisfaction thereof or that he the said Nicholas Ready will do it for him thereupon the afd Henry Travers by Robert Peirce his attorney appears and Imparles till next Court &c
of Baletmore &.c To the Sherr of Somersett County Greeting we Command you that you attached any the goods Chattells Rights or Creditts of Edward Bray late of Somersett County decd (being in the hands of Jn.o Murrow Executor of Hugh Porter who was Executors of the same Edw.d Bray) or in the hands |
