June 18: 1728 Thomas Humphrys foreman Thereupon Command is given to the Sherr of Somersett County that he Should take the afd Ann Heather if &.c to answer &.c And afterwards here in the Same Court Came the said Ann Heather in her proper person and being by the said sherr putt to the bar, And the presentm.t being under her Read is thereupon Instantly demanded how she would acquitt herselfe of the premisses afd says that of the Premisses afd she is guilty thereof and submitts herselfe to the Mercy of the Court for the fact afd Whereupon forasmuch as there is due unto Somersett County Seven Years Service from those that are Convict of Such inordinate Coppulation and such Child or Children to be sold by the Justices of such County where the fact is Committed for thirty one years &.c Wherefore it is Considered by the Justices here that the afd Ann Heather ^be^ Sold unto the biggest bidder for seven years and her Child till he arrives to thirty one years of age Thereupon the said Ann Heather is Sold by the Court for seven Years and her Child till he arrives to the age of thirty one years (according to law in Such Case made and provided) unto Ephraim Heather of the County afd for the Sum of five hundred pounds of tobacco thereupon the afd Ann Heather is discharged from the presentm.t afd &c
Thereupon Command was given tot eh Sherr of Somersett County that he should take the afd Catherine Diall if &.c to answer &.c And afterwards in the Same Court Came the Said Catherine Diall by Levin Gale her attorney and says that the afd Catherine Diall is not Guilty of the premisses afd as by the Presentm.t is upon her Imposed and for tryall thereof putts herselfe upon the Country and George Dashiell who for his said Lordship in this behalfe Prosecutes Likewise Thereupon Command is given to the sherr of Somersett County that he should Cause to Come here twelve &.c by whom &.c to Recognize &.c because as well &.c of which said Preceipt the Said Sherr to witt francis Allen Gent.m Now hereat this day to witt the twentyeth day of august one thousand seven |
