119 was with Colo Whittington takeing up a peice of Land for Thomas Roe at the Devills Island and he Carried the Chain and when they had Run out a peice of Land Called graves End at the uper end of the Said land there was apost set in the marsh which he saw set Down to the Best of his Remembrance and that Thomas Rooes Land Called Purgatory was on the South East Side of the Land Called graves End and that the first Bounder of the Land Called Purgatory was Set at the point Called the Egles Nest point and as Coll Whittington run the Length of the Land Called graves End this Deponient Carried the Chain aCrose the Land Called Purgatory two or three times to try the Bredth aCrose it Being the Land then taken up and further Saith not Geo: Hutchins at which place was Sett a Ceder Post Taken before us Day and Geo Dashiell (seal) Year afd as Wittness our hands and Seales at the said Land Called Purgatory on their Corporall Oaths Rob.t Jones (seal)
Ackman if &.c to answer &.c And afterwards in the Same Court Came the afd Eliz.a Ackman and being by the Sherr sett to the bar is thereupon Instantly demanded how she would acquitt herselfe of the premises afd says that of the premisses afd She is guilty thereof and prays that She may be admitted to make fine to the said Lord proprietary for the fact afd Wherefore it is Considered by the Justices here that the afd Eliz.a Ackman be fined to his Lordship for the fact afd ^thirty Shillings^ (and that she be taken &c) toward the defraying of the County Charge thereupon the said Eliz.a Ackman is discharged and ordered to return into her Masters Service and that her said Master Merrick Ellis Return her to the County Court or the Sher of the County for the time being to reemburst to said County of Somersett all the fees due unto the severall officers by Occasion of the premisses afd &c Whereupon at the prayer of the afd Merrick Ellis the afd Eliz.a Ackman is adjudged to serve him at the Expiration of her Servitude Six full Months which is adjudged by the Court as full satisfaction for all troubles Charges and Loss of time in her Lying in &c Ann Potter Executrix of Thomas Potter and Eliz.a Denston Senr & Jun.r Executrices of W.m Denston being summoned to Court to give Security for the ballance of their Estates are discharged by reason all the Estate is given them by will of the decd &c |
