112 Plank afterwards viz.t to witt the same day and year afd at the County afd and within the afd Jurisdiction to the hands and possession of the afd Jn.o White By finding Came Nevertheless the said John White Knowing the plank afd to belong to the afd Jno Dennis but plotting and fraudulently Intending the Said Jn.o Dennis in that part Craftilly and Subtilly to defraud and deceive he the ^said White the^ afd Plank afterwards to witt the Same day and Year afd at the County afd within the afd Jurisdiction to his own proper use and behooffe did dispose and Convert whereby the Same Jno Dennis says he is worse and hath damage to the value of ten pounds Curr.t Mony and thereof he Brings this Suite &c L Gale P Qeu Pledges &.c Jno Doe R Roe And the afd John White by George Dashiell his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd Plft here also &c Att which said next Court to witt the Eighteenth day of June anno Dom one thousand seven hundred and twenty Eight Came againe as well the afd John Dennis as the afd John White by their attorneys afd and the said John White by his said attorney as before defends the force and Injury when &c and Saith not Guilty P Patriam Plft Likewise Thereupon Command was given to the sherr of Somersett County that he Imediately ^he^ Cause to Come here twelve &.c by whome &.c who Neither &.c to recognize &.c because as well &.c of which said Preceipt the Said Sherr to witt Francis Allen Gent.m now hereat this day to witt the Same day and Year Last Mentioned makes return that he has here Ready twelve &.c as by his preceipt he was Commanded And now hereafterwards to witt the same day and year Comes as well the Said Plft as the Said Deft by their attorneys afd and the Jurors of that Jury Impannelled who being Called Likewise Came to witt James Martin, Jn.o Tull, Samuel Derickson, Henry Toadvine, Isaiah Bredal, Richard Rider, James Jones, William Jones. Edward Jones, Thomas Collins, Thomas Brereton, and Edmond Hough, who being duely Elected tryed and sworn to say the truth in the premisses upon their Oath do say that the afd Jn.o White is Guilty of the trover and Conversion as the Plft above against him hath Complained and do assess the damages of the Same Plft beyond his Costs and Charges to thirty six shillings Curr.t mony and for those Costs and Charges to one pounds of tobacco &c Therefore it is Considered by the Court here the Eighteenth day of June anno Dom One thousand seven hundred and twenty Eight that the afd John Dennis Recover against the afd John White thirty Six Shillings Curr.t mony and One pounds of tobacco his damages afd by the Jurors afd in form afd assessed as also Eight hundred and thirteen pounds of tobacco to the Same Jno Dennis at his Request for his Costs and Charges afd by the Court here of Increase adjudged which Certain damages in the whole do amount unto thirty six shillings Currt mony and Eight hundred and fourteen pds of tobacco and ye afd deft in Mercy &c |
