1727 10 and Custody of the Same Lazarus yett is by w.ch Action hath Accrewed to the said Martha to have and Require of the afd Lazarus the Mare afd Nevertheless the afd Lazarus tho' often thereto Requested the Mare afd to the Same Matha hath not Delivered but the said Lazarus the Said Mare hitherto to ye said Matha to Deliver hath Denyed and Still doth Deny and Unjustly Detain to the damage of the said Martha Twenty Pounds Sterr and Thereof he Brings This Suite &c Roger Woollford pledges J Doe R Roe And the afd Lazarus Maddox by George Dashiell his Attorney Comes and Defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft here also Att which said next Court to witt the twentieth day of June Ann Dom one thousand seven hundred and twenty seven Came again as well the afd Martha Woollford by Roger Woollford her next friend as the afd Lazarus Maddox by his attorney afd and the said Lazarus by his said attorney as before defends the force and Injury when &.c And saith that the plft her action afd against him to have ought not because he saith that he doth not detain the mare of the said Martha in manner and form as the plft above against him hath Complained and of this he putts himselfe upon the Country and the afd Plft in like manner Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to Recognize &.c because as well &c of which said Preceipt the said Sherr to witt Francis Allen Gent Now hereat to witt the Same day and year Last mentioned makes return that he hath here ready twelve &c as by his said preceipt he was Command and now hereafterwards to witt the Same day and Year Came as well the afd Martha was aford by Roger Woollford her Next friend as the afd Lazarus Maddox by his attorney afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt William Holland, Robert Collier, Isaac Marshall, W.m Corde, Isaac Brittingham, W.m Dixon, Jno Purnall Jn.o Donelson Joseph MccClester, Thomas Peal, Charles Townsend and W.m Whittington who being duely Elected tryed and Sworn to Say the truth in the premisses upon their Oath do say that the afd Lazarus Maddox doth detain the Mare from the afd Martha as the Same Martha above against the afd Lazarus hath Complained &c Whereof the same Martha her damages by Occasion of the detaining of the afd Mare against the afd Lazarus ought to recover But because it is not known what Damages the afd Martha hath sustained by occasion of the detaining of the Mare afd therefore it is Commanded the sher of Somersett County that by the Oath of honest and Lawfull men of his Bailywick or County he diligently Inquire what damages the afd Martha has Sustained as ^well^ by occasion of the detaining of the mare afd as for his Costs and Charges by him about his suite in that part Expended and the Inquisition which (thereof) |
