And whereupon the same Betty Gale by Levin Gale her attry saith yt whereas the afd Tobias in
his Life that is to say ye Eleventh day of March Anno Dom one thousand seven hundred & twenty
four at Somrsett Coty within ye Jur of this Court by his Certain Writing obligatory Confessed
himselfe held to the same Betty in the afd twenty four pd.s six shills Curr.t mony of
Maryland to be paid to the same Betty when thereof afterwards he should be requested Nevertheless
the afd Tobias in his Lifetime and the afd Hannah after the Death of the same
Tobias altho' often required the afd twenty four pounds six Shills Curr.t mony as afd
to the same Betty hath not rendered but the same to her hitherto to render doth deny & the afd
Hannah ye same to the same Betty as yett to render doth deny and unjustly Detain whereupon
the same Betty saith she is worse & hath Dam to forty pd.s Like mony & thereof brings
this Suite &.a  And Brings hereinto Court ye Writing Obligatory afd which ye Debt afd in
form afd doth testifie whose Date is the Same Date & year abovesaid &a
                                                                      L Gale P Quer Pledges &.a Jno Doe Rich.d Roe

    And the afd Hannah Burke Executrix as afd by George Dashiell her attorney Comes and defends
the force and Injury when &c and prays Leave to Imparle hereunto untill the Next Court and he hath it
and the same day is given to the afd Plft here also

                Att which said Next Court to witt the Eighteenth day of June anno Dom One thousand
seven hundred and Twenty Eight Came again as well the afd Betty Gale as the afd Hannah
Burke Executrix as afd by their attorneys afd and the same attorney of the afd Hannah says that
he Cannot gainsay the action afd of the afd Betty nor Can he Say but that the Writing Obligatory afd
is the act and deed of the afd Tobias nor but that she detained from the afd Betty the afd Twenty
four Pounds Six shillings Curr.t mony in Manner and form as the afd Betty above against her hath
Complained &c
                               Therefore it is Considered by the Court here the Same day and Year Last Mentioned
that the afd Betty Gale Recover against the afd Hannah Burke Executrix as afd Twenty four pds
six shillings Curr.t mony of Maryland her debt afd and her damages by Occasion of the detaining
of the same debt to                                                                              pounds of tobacco by to ye
315   same Betty by the Court here of her assent adjudged of the goods and Chattells which were of the
afd Tobias Burke at the time of his death in the hands of the afd Hannah Remaining to
be administred if so much thereof in her hands she hath and if so much ^thereof^ in her hands she
hath no then the damages afd to be Levied of the proper goods and Chattells of the afd
Hannah and the afd Deft in Mercy &c
