107 In Testimony whereof I have hereunto Set my hand and affixed the Seale of Dorchester County afd the fourteenth day of March anno Dom Seventeen hundred & twenty & seven Charles Goldsborough Clk Whereupon the same John Esome in his own proper person appears and Thereupon the afd Jno Esome at the prayer of the Plft.s attorney afd is adjudged to give Speciall Bail to the Action afd Thereupon a Certain Joseph McClester of Somersett County Gent present here in Court undertakes for the Said Jn.o Esome that if in Case the afd Jno Rider Shall Recover Judgm.t in the plea afd against the afd Jno Esome or that the afd Jno Esome Shall be therein Convict that then he the Said Jno Esome Shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the Sherr of Somersett County in Satisfaction thereof or that he the Said Joseph McClester will do the Same for him And the afd John Esome in his Own proper person Comes and defends the force and Injury when &.c and Says that he Cannot gainsay the Plft his action afd so as afd Against him brought nor Can he Say but that he did assume upon himselfe in Manner and form as the afd John Rider above against him hath declared nor but that he Owes the afd John Rider the afd two pounds twelve shillings and Six pence farthing Curr.t mony and the declaration in all the words before Expressly Confesseth &.c Therefore it is Considered by the Court here the Eighteenth day June Anno Dom One thousand Seven hundred an twenty Eight that the afd John Rider Recover against the afd John Esome two pounds twelve shillings and Six pence farthing Curr.t mony his damages afd as 281 also Two hundred & Eighty One pounds of tobacco for his Costs and Charges by him about his Suite in that Part Expended to the same John Rider by the Court here of his assent adjudged and the afd Deft in Mercy &c
Keep so that he might have his body before the Justices of his Lordships County Court of Somrsett to be held at Dividing Creek the third tuesday of June then Next to answer unto Betty Gale of a plea that he render unto her the full and Just Sum of thirty Nine pounds Nineteen shill.s & four pence halfe penny Curr.t mony of Maryland which to her he Owes and Unjustly Detaines &.a And that thereof he Should not fail &a And the afd Betty Gale by Levin Gale her attry Proceeded against the afd Mitchell Downes in the plea afd as followeth vizt Somrsett fs: Mitchell Downs Late of Somrsett Co.ty Marriner al.s Dict.s Mitchell Downs of the Co.ty of Kent in the province of Pensilvania was Sumoned to answer unto Betty Gale of a plea that he render unto her the full and Just Sum of thirty Nine pounds Nineteen Shill.s and four pence halfe penny Currt mony of Maryland which to her he owes and Unjustly Detaines &c And whereupon the Same Betty by Levin Gale her attry that whereas the afd Mitchell the fourteenth day of September (Anno) |
