314   assembly in Such Case made and provided &c

 Somersett fs    John Esome Late of Somersett County planter was attached to
answer unto John Rider of a plea of trespass upon the Case &c
             And whereupon the Same Jn.o rider by Levin Gale his attorney
Complaines that whereas the afd John Esome the tenth day of march Anno Dom One thousand
Seven hundred and twenty Seven at Somersett County within the Jurisdiction if this Court was Indebted
to the Same Jno Rider in the Sum of two pounds twelve shill.s and Six pence one farthing
Currant Mony of Maryland as by acc.o thereof hereunto annexed & into Court Brought May
appear and so thereof being Indebted the said John Esome in Consideration thereof afterwards to
witt the Same day and year afd at the County afd and within the afd Jurisdiction upon himselfe
assumed and to the Same John Rider then and there faithfully promised that he when afterwards
he Shou'd be thereto Requested he the afd Sum of two pounds twelve Shillings & Six pence one
farthing Curr.t Mony as afd to the Same John Rider would well and faithfully Content and pay
Nevertheless the said John Esome his promise and assumption afd in form afd made not regarding
But Plotting and fraudulently Intending him the Same John Rider in that part Craftilly and
Subtilly to defraud and deceive the afd two pounds twelve shillings & six pence one farthing
or any part thereof to the same John Rider he hath not paid or him for it in any wise Contented
altho the Same to do the afd Jno Esome afterwards viz.t the same day and year afd at the County afd
and within the afd Jurisdiction by the Same Jn.o Rider was Requested but he the Same hitherto to do
hath altogether Refused and Still doth Refuse  Whereby the Same John Rider Says he
is worse and hath Damage to the value of five pounds three shill.s and a halfe Penny Like
Mony and thereof he Brings this Suite &c      Levin Gale P Quer Pledges &.c   Jn.o Doe Rich.d Roe

                                                                     in the Same County before Henry Ennalls Esq.r and his
                                        associats his said Lordships Justices to Conserve the peace in the Same County
assigned personally appeared in Open Court Coll Jn.o rider abovesaid and made Oath ^up^on the holy
Evangelist of almighty God that the above Account against the afd abovesaid Jno Esome is
Just and true and that he hath received no part or percell thereof
