 Command was Given to the Sher of Somrsett Co.ty that he Should take
Robert Gibbs Late of Somrsett Co.ty Mariner al.s Dict.s Robert Gibbs
of Somrsett County Marriner if he Should be found in his Balywick
and him Should safe Keep so that he Might have his body before the Justices of
his Lordships County Court of Somrsett to be held at Dividing Creek the third tuesday
of June then Next to answer unto Cornelias Dickenson of a plea that he render
unto him the full and Just Sum of Forty pounds Curr.t Silver Mony of the province
afd which to him he owes and unjustly Detaines &a  And that thereof he should not fail &a

       And the afd Cornelias Dickenson by Levin Gale his attry Proceeded against the
afd Robert Gibbs in the plea afd as followeth vizt

       Somrsett fs  Robert Gibbs Late of Somrsett Co.ty Marriner al.s Dict.s Robert Gibbs
of Somrsett Co.ty in the Province of Maryland ^was Sumoned to answer unto Cornelius Dickerson^ of a plea that he render unto him the full
Sum of forty pounds Curr.t Silver mony of the Province af which to him he Owes & Unjustly
Detaines &a      And Whereupon the Same Cornelias by Levin Gale his attry Saith that
Whereas the afd Robert the twenty Eight day of aprill Ann.o Dom one thousand Seven hundred
& twenty Six at Somrsett Co.ty within the Jur of this Court by his Certain Wrighting Obligatory
Granted himselfe to be held & firmly Bound unto the Same Cornelias in the sum of
forty pounds Currt Silver Mony of the province afd to be paid the same Cornelias when
afterwards the Said Robert Shou'd be thereto requested yet the afd Robert though often
thereto requested ye afd Sum of Forty pounds Curr.t mony as afd to the same robert hath not
rendered but the Said robert the Same hitherto to doe hath altogether denyed & still doth
Deny & Unjustly Detaines whereby the Same Cornelias says he is worse and hath Dam to
the value of Eighty pounds Like mony & thereof he Brings this Suite &.a  And the Same
Cornelias brings here into Court the Writing Obligatory afd ^which^ with the Debt afd in form afd
Wittnesseth whose Date is the Same Day and Year afd      L Gale P Quer Pledges &a  J Doe R Roe

          Att which said next Court To witt the Eighteenth day June anno Dom One thousand Seven
hundred and Twenty Eight being the day of the Return of the Said Writt Cometh the afd Cornelius
Dickerson by his attorney afd and the Sherr of Somersett County to whom the foregoeing writt was
directed Likewise Cometh and maketh Return thereof to the court here Endorsed vizt
                                                                   Non Est Inventus P Francis Allen sher

       Whereupon the afd Cornelius Dickerson by his attorney afd Prays that forasmuch as he hath
Complyed with the Law in Order to an attachm.t he may have Judgmt against the afd Robert Gibbs for
his debt afd by way of attachm.t according to act of assembly &.c  Wherefore for that it seems to
the Court here that the said Cornelius Dickerson has Complyed with the Law as alledged

       Therefore it is Considered by the Court here that the afd Cornelius Dickerson Recover against
the afd Robert Gibbs forty pounds Currt Silver Mony his debt afd as his damages by occasion
of the same Debt to the same Cornelius by the Court here adjudged by way of attachmt against
