Come and defend the force and Injury when &.c And pray Leave to Imparle hereunto untill the next Court and they hath it and the Same day is given unto the afd Plfts here also Att which said Next Court to witt the Ninteenth day of March anno Dom One thousand Seven hundred and twenty Eight seven Comes againe as well the afd James Martin and Mary his wife Executrix as afd as the afd Mary Taylor Execute wife of the afd Colebourn Taylor Executrix of the afd William Bolitha by their attorneys afd and the afd James Martin and Mary his wife by their said attorney says (that the afd Colebourn Taylor since the day of the Continuance of the plea afd is dead &.c thereupon against the afd Colebourn nothing further thereof is made &.c) that the Cause of action afd does survive to them against the afd Mary ^Taylor^ Bolitha Excutrix as afd according to the form of the Statute in Such Case Lately made and provided thereupon further day is given unto the afd Mary Taylor Executrix as afd here untill the Next Court to answer unto the afd action in the plea afd and the afd same day is given unto the afd James and Mary here also &c Att which said next Court to witt the Eighteenth day of June anno Dom One thousand seven hundred and twenty Eight Came again as well the afd James and Mary his wife Exrx as afd As the afd Mary Taylor Executrix as afd by their attorneys afd and the same Mary Taylor by her said attorney as before defends the force and Injury when &c and saith that he Cannot gainsay the Plfts their action afd nor Can he say but that the said William Bolitha in his Life time did assume upon himselfe in Manner and form as the same James and Mary above against her hath Complained nor but that the same William was Indebted as above and the Same declaration in all the words before Expressly Confesseth &c Therefore it is Considered by the Court here the same day and Year Last Mentioned that the afd James Martin and Mary his wife Executrix as afd Recover against the afd Mary Taylor Executrix of the afd William Bolitha four hundred and Sixteen pounds of tobacco their damages afd 247 in form afd Confessed as also two hundred and forty Seven pounds of tobo for their Costs and Charges by them about their Suit in that Part Expended to the Same James and Mary by their Court here of their assent adjudged &.c of the goods and Chattells which were of the afd William Bolitha at the time of his death in the hands of her the said Mary Taylor Executrix as afd remaining to be administred if so much thereof in her hands she hath and if so much thereof in her hands she hath not then the Cost afd belevied of the proper goods and Chattells of the same Mary Taylor & ye afd deft in Mercy &c |
