1728 105 take nothing by his writt and declaration afd but be in Mercy for his falce Clamour and that the afd francis goe thereof without day &c And also it is Considered by the Court that the afd francis Allen Recover against (140) the afd Ephraim Willson One hundred & forty pounds of tobo to the same francis by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute thereof Lately made and provided by the Court here adjudged &a
attorney Complain that whereas the afd William in his Life time the tenth day of June One thousand seven hundred and twenty one at Somersett County afd within the Jurisdiction of this Court was Indebted unto the same Robert in the Sum of four hundred and sixteen pounds of tobacco as by account herewith in Court produced may appear and so thereof being Indebted the said William be in his Life time afterwards viz.t the Same day and Year afd at the County afd within the afd Jurisdiction in Consideration thereof upon himselfe assumed and to the same Robert Martin in his Lifetime then and there faithfully promised that he when afterwards he should be thereunto Required he the afd sum of four hundred and Sixteen pounds of tobacco to the Same Robert in his Life time would well and faithfully pay and Content Nevertheless ye said William in his Life time and the afd Mary Taylor since his Death to whome whilst she was Sole Execution of the Last Will and Testament of the Same William was in due form of Law Committed and ye afd Colebourn and Mary since the Espousals Between them Celebrated the Promise and assumption afd of ye afd William in his Life Time so as afd Made Little regarding But Plotting and fraudulently Intending him the afd Robert in his Life time and the afd James and Mary his wife Since his death in that part Craftilly and Subtilly to defraud and Deceive Neither the afd Will.m in his Life time nor the afd Mary Taylor Since his Death whilst She was sole Nor the afd Colebourn and Mary his wife Since the Espousals between them Celebrated the afd Sum of four hundred and Sixteen ^pds of tobo^ to the Same Robert In his Life Time or the afd James and Mary his wife Since his death have not paid or any of them for it in any wise Contented altho' the Same to Do the Same William in his Life time by the afd Rob.t in his Life time afterwards to witt the Same day and Year afd and the afd Colebourn & Mary his wife Since the death of the Same William and the Espousalls between them Celebrated by the same James and Mary his wife Since the death of the afd Robert the tenth day of June Anno Dom One thousand Seven hundred and Twenty Seven at Somersett County within the Jurisdiction of this Court were thereto requested but they and Every of them the same hitherto to Do have altogether refused & the Said Colebourn & Mary his wife ye same to Do Still do refuse to the damage of the Same James & Mary his wife one thousand five hundred pounds of tob.o and thereof they Brings this Suite and ye Same James & Mary Brings hereinto Court the Letters Testamentary &c by which &c Levin Gale P Quer Pledges &c Jn.o Doe Rich.d Roe |
