104 And the afd Charles Lowe in his Own proper person Comes and defends the force and Injury when &.c and says that he Cannot gainsay but that he did promise and assume upon himselfe in manner and form as the afd Thomas by the declaration afd above supposeth and the same declaration in all the words before Expressly Confesseth &c Therefore it is Considered by the Court here the Eighteenth day of June anno Dom one thousand seven hundred and twenty Eight that the afd Thomas Dashiel Recover against the afd Charles Lowe three pounds Ten shillings and two pence Curr.t mony his damages afd above in the declaration specified as also two hundred and Twenty six pounds of tobacco for his Costs and Charges by him about his Suite in that part Expended to the same Thomas by the Court hereof his assent adjudged and the afd Defend.t in Mercy &c
Ephraim in Somersett County in November Court anno Dom One thousand Seven hundred and twenty six in an action therein by the said Ephraim brought by the Judgm.t of the Same Court Recovered against a Certain John Videll the Sum of four pounds Sixteen Shillings and Nine pence Curr.t mony and three hundred and two pounds of tobacco as well for damages which he Sustained as well by Occasion of a Certain trespass upon the Case of the Said Ephraim by the afd John Videll made as for his Costs and Charges by him about his Suite in that part laid out and Expended by the Record thereof in the same Court fully appears and afterwards that is to Say in the Novem Court of Somersett ^County^ afd in the Year afd the same Ephraim out of the Same Court did prosecute against the afd John Videll the Lord Proprietarys writt to take the said John Videll to satisfie unto the same Ephraim his damages afd to the then Sherr of Somersett County directed by which said Writt the said Lord proprietary the sid then Sher Commanded to take ye Said John Videll if he should be found in his Bailywick and him safe Keep so that he had his body before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of March then Next to Satisfie unto the Same Ephraim the afd Sum of four pounds Sixteen shill.s and Nine pence Curr.t mony and three hundred and two pounds of tobacco afd and that he should have then and there that writt which said Writt the Same Ephraim afterwards and before the return thereof that is to say the tenth day of December anno Dom One thousand Seven hundred and twenty Six at Somersett County afd and within the Jurisdiction of this Court unto the afd francis Allen then sher of Somersett County in form of Law delivered by vertue of which said Writt the Same Francis Allen afterwards and before the return of the Same writt that is to say the thirtieth day of December ann.o Dom One thousand Seven hundred and twenty Six then sher of the said County being at |
