also five hundred and Eighteen                                  pounds of tobacco for his Costs and Charges to the afd Benj.a
by the Court here of his assent of Increas adjudged which Certain damages themselves in the whole do amount to
one thousand and five pence and five hundred and Ninteen                                    pounds of tob.o and ye afd deft
in mercy &c

 Somersett fs  Charles Lowe late of Somersett County Planter was attached to answer unto Thomas
Dashiell of a plea of trespass upon the Case &.c
                 And whereupon the same Thomas by George Dashiell his attorney Complains that whereas
the afd Charles the tenth day of January anno Dom one thousand seven hundred and Twenty
Seven Eight at Stepney Parish in Somersett County within the Jurisdiction of this Court was Indebted to the same ^Thomas^ in the sum
of three pd.s ten shill.s & two pence Curr.t Mony of maryland as by acc.o hereunto annexed may in Court appear & the
same Charles being so thereof Indebted in Consideration afd at ye time & place afd within the afd Jurisdiction did
upon himselfe assume and to the same Thomas did then & there faithfully promise that ye afd Sum of three pounds ten
shill.s & two pence money as afd he would well and faithfully Content and pay Nevertheless the same Charles his
promise and assumption afd in form afd made not regarding but Plotting and fraudulently Intending him the same
Thomas in that part to Deceive and Defraud ye same Charles the afd Sum of three pd.s ten shillings & two pence mony
as afd or any part thereof to the same Thomas he hath not paid or him for it in anywise Contented altho' ye same
Charles his p the Same to do the same day and year afd by the same Thomas was requested but he the same
hitherto to do hath Denyed and Still doth Deny Refuse to the Damage of the Same Thomas of Seven pounds
and four pence Like mony and thereof he Brings this Suite &c   Dashiell P.r Quer pledges &.c Jno Doe Richd Roe
