1728 104 at the County afd within the Jurisdiction of this Court the afd John Videll did take and arrest and the same John into his Custody then and there had and Imprisoned in Execution of and for the damages afd untill the fourth day of february the year afd at which said fourth day of february afd in the Year afd the said Francis Allen (the Sherr of the County of Somersett afd being and the afd John Videll in his Custody in Execution for the damages afd being) the same John Videll at Somersett County afd within the Jurisdiction of this Court Out of Custody of him the said Francis at Large whether he would ^to^ goe and Escape without the Lycence and Consent and against the will of him the said Ephraim ^did permitt ye Damage afd & every part thereof to ye said Ephraim^ being unsatisfied ^and^ the Said John ever since hitherto to places to the said Ephraim unknown did and Yett doth absent and Eloyne himselfe himselfe so that the said Ephraim Could by said Preceipt of Law gett him taken and thereby the said Ephraim hath totally Lost the being fitt and advantage of the Recovery afd whereby he says that he is worse and hath damage to the value of ten pounds Curr.t mony and Six hundred pounds of tobacco and thereof he brings this Suite &.c Levin Gale P Quer Pledges &c Jno Doe R Roe And the afd Francis Allen by in his Own proper person Comes and defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the Next Court and he hath it and the Same day is giv given to the afd Plft here also Att which said Next Court to witt the fifteenth day of August anno Dom One thousand seven hundred and Twenty seven Comes againe as well the afd Ephraim by his attorney afd as the afd francis in his Own proper person and the said Francis prays further Leave to Imparle hereunto untill the Next Court and he hath it and the Same day is given unto the afd Ephraim here also Att which said Next Court to witt the twenty first day of Novem Anno Dom one thousand Seven hundred and twenty Seven Comes again as well the afd Ephraim by his attry afd as ye afd Francis in his own Proper person And the Said Francis prays further Leave to Imparle hereunto untill the Next Court & he hath it & the same day is given unto the afd Ephraim here also Att which said Next Court to witt the Nineteenth day of March Ann.o Dom one thousand Seven hundred and twenty Seven Comes again as well the afd Ephraim by his attry afd as ye afd francis in his own Proper Person & the Said Francis prays further Leave to Imparle hereunto untill the Next Co.t & he hath it & the Same day is given unto the afd Ephraim here also Att which said Next Court to witt the Eighteenth day of June Anno Dom one thousand Seven hundred & twenty Eight Comes again as well the afd Ephraim by his attry afd as the afd Francis in his own Proper Person And whereupon the said Francis in his own Proper person as before Defends the force and Injury when &a And Saith that the afd Ephraim his action afd against him the Said Francis to have and Maintain Ought not Because he Saith that after the taking of the afd Jn.o Videl into the Custody of the afd Francis in Execution for the Dam.s afd & before the Escape above Supposed to be made to witt the Sixteenth day of Janry Ann.o Dom one thousand Seven hundred & twenty Six the afd Jn.o Vidal then in Execution for the Dam.s afd under the Custody of the afd Francis in prison of the Co.ty afd at Somrsett County afd being he the Same Jn.o Vidall the Prison afd in Somrsett Co.ty afd with force & arms did break and out of the Prison afd against the will of the Said Francis then (and) |
