 Command was given to the Sherr of Somersett County that he should
take William Hopkins late of Somersett County Planter al.s dict.s Will.m
Hopkins sub Sherr of Somrsett County if he Should be found in his
                            bailywick and him Should safe Keep so that he might have his body before the
Justices of his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday
of June then next to answer unto John Rogers of a plea that he Render unto him the full and Just
sum of two thousand pounds of good sound Merchantable Leafe tobacco in Cash which to him he owes
and unjustly detaines &c and that thereof he should not fail &c

            And the afd John Rogers by Levin Gale his attorney Proceeded against the afd William Hopkins
in the plea afd as followeth viz.t
                                                          Somersett fs  William Hopkins Late of Somersett County planter
al.s Dict.s William Hopkins sub sherr of Somersett County was Sumoned to answer unto John Rogers
of a plea that he Render unto him the full and Just Sum of two thousand pounds of good sound
merchantable leafe tobacco in Caske which to him he Owes and Unjustly detaines &c

          And whereupon the same Jn.o Rodgers by Levin Gale his attorney saith that
whereas the afd William the twenty Seventh day of aprill Anno Dom one thousand Seven hundred
and twenty six at Somersett County within the Jurisdiction of this Court by his Certain writing
obligatory granted himselfe to be held and firmly bound unto the same John in the full &
Just Sum of two thousand pounds of good sound Merchantable Leafe tobacco in Cask to
be paid the same Jn.o when afterwards the said William should be thereto required ye afd
Sum of Two thousand pd.s of good sound Merchantable Leafe tob.o in Caske to the same John
hath not Rendered but the said William the Same hitherto to do hath altogether denyed &
Still doth deny and Unjustly Detain whereby the same Jn.o Says he is worse & hath
damage to the value of three thousand pd.s of tob.o & thereof he Brings this Suite &c

    And the same John Brings hereinto Court ye writing Obligatory afd which ye Debt
afd in form afd wittnesseth whose date is the same day & year afd
                                                         Levin Gale P Quer Pledges &c Jno Doe R Roe

A Copy of the foregoeing Declaration was made and Sent to be Served on the deft with
the writt in ye Plea afd as followeth viz.t
                                                                            Att which said third tuesday of June
to witt the Eighteenth day of the Same Month Anno Dom One thousand Seven hundred
and twenty Eight being the day of the return of the said Writt Cometh the afd Jno rodges by
his attorney afd and the Sherr of Somersett County to whome the foregoeing writt was directed
Likewise Cometh and Maketh return thereof to the Court here Endorsed in these words
following vizt            Cepi Corpus    P Me       Francis Allen sher

And the said William Hopkins in his Own proper person Comes and defends the force and
                                                                                                                            Injury
