99 thereof and thereof for tryall putts himselfe upon the Country and Levin Gale who for his Said Lordship in this Behalfe Prosecutes Likewise Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to come here twelve &c by whom &c who neither &c to recognize &c Because as well &c of which Said Preceipt the Said Sherr to witt Francis Allen Sher Gent makes return that he hath here ready twelve &c as by his said Preceipt he was Commanded and the Jurors therein Impannelled being Called Come to witt Charles Cottingham, Thomas Humphreys, Stephen Horsey, Peter Frazer, Moses Duskey, George Scott, Francis Lancake, James Jones, Jno Shiles David Hutson Jn.o Aydelett and Jno Townsend Jun.r who being duely Elected tryed and Sworn to Say the truth in the premisses upon their Oath do Say that the Said Alexander Maddox is guilty of the premisses afd &c Wherefore it is Considered by the Justices here that the afd Alexander Maddox be fined to his Said Lordship the sum of thirty Shillings ^Currt money^ for the fact afd to be appropriated toward the defraying of the County Charge and is Committed into the Custody of the Sherr of Somersett County thereto Remain untill he gives security for the ^severall officers fees due by occasion of the premisses afd &c^ fees afd the Said Sherr Present took Charge of the Said Alexander Maddox accordingly afterwards In the Same Court Came a Certain Thomas Maddox into Court and became Security and undertakes for the Said Allexander Maddox to pay the Severall Officers their Fees due by Occasion of the premisses afd &c thereupon ye Said Alexander Maddox is discharged from out of Custody afd &c Whereupon Its ordered by the Court that the Said Alexander Maddox give Recognizance with One Security in twenty pounds Sterr Each to Save and Keep harmless the Inhabitants of Somersett County from time to time and at all times hereafter from all Costs Charges ^and^ troubles whatsoever for or by reason of the Birth Nourishm.t and bringing up of the Said Child &c Thereupon the Said Alexander Maddox and Thomas Maddox both of Somersett Present in Court acknowledged themselves to Owe and Stand Justly Indebted unto the His Lordship the Lord proprietary in the Sum of twenty Pounds Sterling Each for the use of the Inhabitants of Somersett County afd to be Levied upon his bodys Goods or Chattles Lands or tenements ^severally^ In Case they the said Alexander Maddox and Thomas Maddox their heirs Executors or adm.rs or any of them do not from time to time and at all times hereafter acquitt discharge and save harmless the Inhabitants of Somersett County afd from all Costs Charges and troubles whatsoever for or by reason of the Birth maintainance Nourishm.t and bringing up of the Said Child and of and form all ^other^ Suites Charges troubles and demands whatsoever touching or Concerning the Same &c Thomas Peal appears according to his Recognizance for his good behaviour and is discharged therefrom &c Cornelius Bivans appears according to his Recognizance for ye good behaviour and is discharged therefrom &c |
