96 The petition afd being read and heard and the premisses Considered It's therefore Ordered by the Court that a Commission Issue as by the Petition afd is praid &.c and that Joseph Pemberton, George Scott, James Macmorie ^and Thos Humphrys^ all of Somersett County Gent.m be Commissioners and Execute the same Commission according to act of assembly in Such Case made and provided &c
Galloway the Other Recover the Boundarys whereof are decayed and Like to be Lost and the wittnesses to prove them Ancient and Infirm Your Petitioner therefore prays your worships to Issue a Commission according to the act of assembly in Such Case Lately made to such persons as your worships shall think proper to Examine Evidences to perpetuate the bounds of y.e Land afd &c The Pet.n afd being read and heard and the premisses Considered It's therefore ordered that a Commission ^Issue^ as by the Petition afd is prayd and that Robert King, Ephraim Willson, Thomas Williams, and Jeffr'y Long all of Somersett County Court be Commissioners and Execute the same Commission according to act of assembly in Such Case made and provided &c
Thereupon Command is given to the Sherr of Somersett County that he Should take the said Bruffe Broughton if &.c to answer &.c And afterwards in the Same Court Came the Said Bruff Broughton in Custody of the Sherr of Somersett County and being by the said Sherr Put to the Bar is thereupon Instantly demanded how he would acquitt himselfe of the premisses afd above upon Imposed says that of the premisses afd above him Imposed he is guilty thereof and puts himselfe in Mercy of the Lord proprietary and is willing to pay his fine for the fact afd Wherefore it is Considered by the Justices here that the Said Bruff Broughton be fined to the Lord proprietary for the fact afd the Sum of five hundred pounds of tobo the one halfe thereof to be appropriated to the Publick School for Somersett County the other halfe thereof to the Informer or him or them that Shall Sue for the Same thereupon the Said Merrick Ellis the Informer present herein Court freely Remitteth his part of the fine afd thereupon the Said Bruffe Broughton is discharged he giving Security for the payment of all the Officers due by Occasion of the premisses afd Thereupon a Certain Jn.o Atkinson present here in Court undertakes for the said Bruffe Broughton for the payment of the Severall Officers Fees due by Occasion of the premisses afd &c |
