89 Somersett County Labourer the thirtieth day of Novem ann.o Dom One thousand Seven hundred and twenty five with force and Arms &c at the County afd within the Jurisdiction of this Court One Silver Spoon of the value of two hundred pounds of tob.o of the Goods and Chattells of a Certain Mary Hampton then and there being found then and there feloniously did take Steal and Carry away against the Peace of the right honrble the Lord proprietary his good Rule and government and also against the form of the act of assembly in Such Case made and provided L Gale Cl Peace Test Will.m Planner, Bruffe Broughton, Mary Hampton, W.m Calvert, and W.m Mathews On the Backside of the foregoeing Bill of Indictment it was thus Endorsed viz.t Billa vera Adam Hitch foreman thereupon Command is given to the Sherr of Somersett County that he take ye Said Thomas Traverse Late of Somersett County Labourer if &c to answer &c and afterwards in the Same Court Cause the Said Thomas Travers in Custody of the Sherr of Somersett County into whos Custody before that time was Committed for the Cause afd and thereupon the Said Tho.s Travers being by the Sherr Sett to the Bar (and Indictm.t Read) is Instantly demanded how he would acquitt himselfe of the felony afd as above upon him Imposed, Says that of the felony afd as by the Indictm.t above upon him Imposed he is no way guilty thereof and for tryall thereof putts himselfe upon the Country and his Lordships attorney who for his Said Lordship in this behalfe prosecutes Likewise Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c of which Said Preceipt the Said Sherr to witt Francis Allen Gent makes return that he has here Ready twelve &c as by his Said Precept he was Command^ed^ and the Jurors therein Impannelled being Called Came to witt Charles Cottingham, John Waters, Stephen Horsey, Peter Frazer, Moses Driskill Danl Maddox, Jn.o Turpin, James Jones, John Shills David Hutson, Jn.o Aydelott, Jn.o Twownsend Junr who being duely Elected tryed and Sworn to Say the truth in the premises afd upon their Oath do say that the Said Thomas Travers is guilty of the felony whereof he Stands Indicted Whereupon the Court here valued the Silver Spoon in the Indictm.t afd said to be Stolen to One hundred and fifty pounds of tobacco wherefore it is Considered by the Justices that the said Thomas Travers pay unto the Said Mary Hampton the party deprived four fold of the value of the goods Silver spoon afd amounting in the whole to Six hundred pounds of tobacco (the afd spoon being valued as afd according to Law) and that the Said Thomas Travers be whipt with twenty five Lashes on the Bare Back well Laid on untill the Blood appear and that he Stand in the Pillowry halfe an hour and that he be taken &c and thereupon as to the Corporall Punishm.t afd Command is given to the Sherr of Somersett County that he do thereof Immediate Execution according to the Judgm.t afd rendered by whiping the afd Thomas Travers at the Publick whiping post with twenty five Lashes on the bare Back well Laid on untill the blood appear and by sitting him in the pillowry halfe an hour afterwards (in) |
