of three years old &c the Said Joseph Harrison appeared here in Court in Custody of the Sherr of Somersett County thereupon It's Ordered by the Court that the Said Joseph Harrison give Security for to Stand and abide the Judgm.t of the Court &c Thereupon the Said Joseph Harrison in his proper person acknowledged himselfe Indebted unto the Right honrble Charles absolute Lord and proprietary of the province of Maryland in manner and form following that is to Say the Said Joseph Harrison in twenty pds Sterling and Joseph Pemberton and Jno Browne his Securitys in ten pounds Sterling Each separately of their goods and Chattells Lands and tenements to be Levied for the Use of the Said Lord proprietary his heirs and Successors In Case the Said Joseph Harrison do not Stand and abide the Judgmt of this Court and not to depart without Leave &c Somersett fs The Jurors for the right honrble the Lord proprietary of this province that now is for the body of Somersett County upon their Oath do present that Joseph Harrison Late of Somersett County Labourer the tenth day of march ann.o Dom One thousand Seven hundred and twenty four with force and arms &c at Somersett County afd within the Jurisdiction of this Court One hogg of the Price of One hundred and fifty pounds of tobacco of the goods and Chattells of a Certain John Langsdale then and there feloniously did take Steal and Carry away against the Peace of the Right honrble the Lord proprietary his good rule and Government and also against the form of the act of assembly in Such Case made &c L Gale P Dom Propr Testes Robert West, Jonathan Jackson, Henry Toadvine On the Backside of the foregoeing Bill of Indictm.t it was thus Endorsed viz Billa vera vera Adam Hitch foreman Thereupon Command is given to the Sherr of Somersett County that he Should take the said Joseph Harrison Late of Somersett County Labourer if &c to answer &c and afterwards in the Same Court Came the Said Joseph Harrison in Custody of the Sherr into whose Custody ^before that time^ was Committed for the Cause afd and the said Joseph Harrison being by the Sherr sett to the Bar (and Indictmt Reced) is thereupon Instantly demanded how he he would acquitt himselfe of the felony afd says that of the felony afd he is noe ways guilty thereof and thereof for tryall putts himselfe upon the County and Levin Gale who for his Said Lordship in this behalfe prosecutes Likewise Thereupon Command is Immediately given to the Sherr of Somersett County that Immediately he Caus to Come here twelve &c by whom &c who neither &c to recognize &c becaus as well &c of which Said Preceipt the said sherr to witt Francis Allen Gent makes relicon that he hath here ready twelve &c as by his said precept he was Command and the Jurors therein Impannelled being Called Came to witt Charles Cottingham |
