86 attempted to Offend or shall hereafter presume to Offend or attempt to offend in the abuse of weights or measures or in selling of any Liquors according to the form of the acts of assembly for the Common good and profitt now in this province made and used and also of the Sheriffs bailiffs Constables and others Officers who have or Shall hereafter misbehave themselves in the Execution of their Offices or have been fearfull Remiss or Negligent in the Execution thereof or Shall hereafter happen so to be within Our County afd and of all and Every the articles matters and things whatsoever howsoever or by whomsoever in Our County afd done or Committed or that Shall hereafter happen to be done or attempted Concering the premisses or any of them and to Inspect all Indictm.ts so before you or any of you taken or to be taken or before Our Late Justices of the Peace within Our Said County had and taken and not yett determined and process thereon against all or any person or persons so Indicted or which Shall hereafter happen to be Indicted within Our County afd to make and Continue untill they shall be taken Surrender themselves or be Out Lawed and to hear and determine all and Every the felonys witchcrafts Enchantments arts magick trespasses fore stallings Regratings Riots Indictments and all Other the matters afd according to the laws of great brittain and this Our Province had and used or to be had and used and the Said delinquents and of every of them to Chastize and Punish by Fines Ransoms americaments forfeitures and Otherwise according to the Laws and Customs of the said Kingdom and province and the form of the Statutes and acts of assembly thereof had and used or to be had and used but we will not that you proceed in any the Cases afd to take life or member but that in Every Such Case you Said the Prisoners with their Indictments and the whole matter depending before you to our Justices of Our next Provinciall Court to be held for this our province be it whensoever or wheresoever to be holden there to be tryed and we Command you and Every of you Diligently to Intend the Keeping the Peace Ordinances & Statutes and all & Every the premises and that at your County Courts you make Inquisition & hear and Determine as afd Doing therein what to Justice appertains according to the Laws and Customs of the Kingdom & Province afd and further we Do Constitute ordain & appoint you the Said Samuel Hopkins WIlliam Planner John Jones Willm Fasitt John Smith of Baltemore hundred William Stoughton John Caldwell John Macclester John Handy James Dashiell John Scott and Robert King or any three or more of you as afd to Issue Out writts precepts process and attachments and hold plea of Oyer and terminer of all actions popular and upon the Statute and of all actions personall of what sort soever where in the demand doth not Exceed the Sum of One hundred pounds Sterlling or thirty thousand pounds of tobacco and all actions personall now depending before you be the demand how great soever and after Judgm.t Execution to award in all Such Causes and actions afd according to the Laws Orders and Customs of that part of the Kingdom of great Brittain Called England as of this Our province of maryland in which Said actions so to be tryed we do Constitute ordain and appoint you the Said Samuel Hopkins William Planner John Jones William Fasitt John Smith of Baltemore Hundred William Stoughton John Caldwell John MaClester John Handy James Dashiell John Scott and Robert King and None Other to be Judges also by these presents We do Command the Sherriff of our Said County of Somersett that at the Severall Courts to be held for our Said County he give his attendance & Cause to Come before you or any three or More of you as afd Such & So many Good & Lawfull men of his Bailywick out of Each & Every hundred thereof by whom y.e truth of the Matter in the premises may be the better Known & Enquired off Lastly You Shall Cause to be Brought before you at your Said Courts all Writts precepts process & Indictments to your Courts & Jurisdiction belonging that the same may be Inspected and by Due Course Law Determined Wittness our Trusty & Welbeloved Charles Calvert Eq.r our Captain Generall & Governour in & over our Said province of maryland this thirty first day of January in y.e 11.th year of our Dominion &c Anno Dom 1725 Charles Calvert On y.e Back of y.e foregoeing Commission In was thus Endorst (viz) |
