81 Scarbrough about sixteen years sence about the Bounds of the Land afd Called Marduke he Heard them say that the first bounder was some small space beyond the Midle branch neare the Old road in or near Neare the first Swampy Ground &c Cap.t Nath Hopkins being Sworn also on the Holy Evang.t sayeth that about twenty six agoe the afd Math Scarbrough Carried him unto a marked White Oak Tree Standing near unto a place Called the head of bogertenorton Creek and told him that that tree was one of his Boundaryes of that tract of land Called Dorham house Cap.t Nathaniel Hopkins also Sayeth that about Twenty years since the afd Math Scarbrough also Carried him with a Certain Henry ayers unto a marked Corner gum tree Standing in the side of a Swamp near unto ye place where ye sd Henry then sitted & dwelt & y.t he also ^saw^ & followed a Line of Marked trees from y.e s.d gum Downwards towards y.e sea side about halfe a mill being as he was Informed by s.d M.r Scarbrough a Line of ma^r^ked trees of the Land Called Durham house &c William Richardson Sworn on the Holy Evang.st Sayeth that some time after that John Porter purchased part of that tract of Land Called Durham house he ye said John Porter Carried him ye Said William unto a Corner Marked white Oak tree standing near ^unto^ to a place Called the head of Bogerternorton Creek and told him that M.r Scarbrough told him that that tree was one of his Lower Boundaries &c at The Request of John Scarbrough we farther In fact that we Sumoned M.r William Whittington to give his Evidence in Relation to the bounds of the Land Called Durham house so far as Concerned the said Scarbrough part thereof which M.r Whittington utterly refused to due but bid M.r Scarbrough take his advantage against him & del his worst with other words to the Like purpose &c The Above Examination of Evidences with the Above Depositions was Taken This 30th of August Anno Dom 1725 p Jno Purnall Johnson Hill Fisher Walton
Sum of fifty Eight Pounds four Shill.s & Six pence Curr.t Money to be paid unto the Said Thomas, richard, sarah Mathew & Mary Goslees there heirs Exrs Adm.rs or Assignes to y.e which payment well & truly to be made & done wee Bind Our Selves Our & Either of our heirs Exrs & Adm.rs for y.e whole & in y.e whole firmly by these presents Sealed with Our Seales and Dated this 16.th day of November Anno Domini 1725 The Condition of the above obligation is Such that if the Above Bound James Goslee Thomas Holbrok & Thomas Brereton or Either of them or Either of there heirs Exrs of Admrs doe well & truly pay or Cause to be Paid unto the above Said Thomas, Richard, Sarah Mathew & Mary Goslees their heirs Exrs admrs or Assignes the full & Just Sum of twenty Nine pounds two Shills & three pence Being the Just Ballance due to them from their Said fathers Estate when they shall attain to full age according to act of assembly to be paid according to will of y.e dec.d then the above Obligation to be void otherways to remain in full force & vertue Sealed & Delivered James Goslee (Seal) In Presents of Thom.s Holbrook (Seal) William Taylor Thom.s Brereton (Seal) Thomas Hayward |
