81 Bounder of mummouth afd and desired us to Certifie that agreement made between them to be Entered upon Record &c Levin Gale George Dashiell
that we Have Appointed you or any three or two of you to be our Commissioners to Examine Evidences on behalfe of a Certain John Scarbrough of the County afd Gentl in relation to the Bounds of two Tracts of Land Lying in the County afd on the Seabo^a^rd Side the one Called Dorham house the other Marduke we Require you or any three or two of you that at Some time & place as to you or any three or two of you Shall Seem Conveniant you meet on the afd two Tracts of Land Names as afd and there Cause to Come Before you or any three or two of you all Such Evidences as shall be to you or any three or two of you Nominated By the Said Complainant or Defendant of any and that you Examine them upon there Corporall oaths to be by you or any three or two of you administered on the holy Evangelist of almighty God in the presents of the Complainant afd (& Defendant if any) Tuching the truth or rememberances of There Knowle^d^ge or any thing that may related to the Cause afd and that reducing the severall Deposissons into wrighting you send the same Together with This our Commission under your or any three or two of your hands to us Our County Court of Somersett with all Conveniant Speed wittness Samuell Hopkins Gent Chiefe Justice of our Said Court y.e 20th day of March in y.e tenth year of our Dominion &c ann Dom 1725 On the Back ^side^ of the foregoing Commission it was thus Endorsed viz.t Memorandum this day to witt the thirtieth day of august ann.o Dom 1725 Came John Purnall, Johnson Hill and Fisher Walton persons Nominated in the within Commission and made Oath on the holy Evangelist that they would Justly and truely Execute the same without Prejudice favour or affection to any person or persons whatsoever Sworn Before me Samuel Hopkins Maryland Somersett County fs: In Pursuance of a comission to John Purnall Johnson Hill Fisher Walton &^ William Cord or any three or two of them to Examine Evidences ^on^ of beha^l^fe of John Scarbrough in relation to two Tracts of or persells of Land the one Called Merduke the other Derham house we the Subscribers have mett on the Lands afd ^and^ proceed to Examine Evidences as followeth M.r William Whittington aged about forty two years being Sworne on the holy Evangelist of Almighty God Saith that Sometime in his fathers Life time upon some Discourses he had with his father about the Bounds or first Bounder of Merduke a Tract of Land Called Marduke then Then belonging to M.r Marthew Scarbrough his father Told him that Dorman Partrick then one of the Near Inhabitants told him yt M.r Scarbroughs first Bounder of Marduke stood on the Left hand of the then road that Leads to Bogurtenorton some Distance beyond y.e Midlebridge or Branch Cap.t Nath Hopkins aged about fifty one years being Sworn on the holy Evengelist also Declear^eth^ that upon some Discourses he heard between Coll William Whittington and Mr Math. (Scarbrough) |
