(8) Attorney Complains that whereas the afd Thomas the Thirty first day of October One thousand seven hundred and Eighteen at the County afd within the Jur of this Court was Indebted to the afd Blandina in the sum of Eight Hundred and fifty pounds of Good sound Merchantable Leaf tobacco as by his Note under hand here within Court Produced may more fully appear and so thereof Being Indebted the same Thomas In Consideration Thereof afterwards that is to say the afd Thirty first day of October In the year afd within the fd Jur upon himself assumed and to the same Blandina Then and there faithfully Promised that he when afterwards should Be thereunto requested By the same Blandina the afd sum of Eight Hundred & fifty pounds of Tobacco Good sound Merchantable Leaf Tobacco to the afd Blandina he would well and faithfully pay Content and pay Nevertheless the afd Thomas his promise and assumption ^afd^ in form afd made Little reguarding But plotting & fraudulently Intending the afd Blandina In that part Craftilly and Subtilly to Defraud and Deceive the afd Thomas Timons the afd Sum of Eight hundred and fifty pounds of Tobacco as afd or any Part Thereof to the afd Blandina (although the afd Thomas afterwards that is to say the tenth day of June One thousand seven hundred and Twenty Two at the County afd within the Jur afd was By the said Blandina Thereunto requested) hath not paid or her for it In any wise Contented But the same Thomas the same to the said Blandina hitherto to pay or any wise to Content hath altogether refused and still doth refuse whereby the Same Blandina says she is the worse and hath Damage to the value of Seventeen hundred pounds of tobacco and Thereof she brings this Suite &c L Gale P Qur pledgs John Done Richd Roe And the afd Thomas Timons by George Dashiell his attorney Cometh and Defendeth the force and Injury when &c and prayeth Leave to Imparle hereunto untill the Next Court and he hath it and the same day is Given to the afd Blandina Bozman also Att which said Next Court to witt the sixteenth day of March Anno Dom one thousand seven hundred & twenty four Came again as well the afd Blandina Bozman as the afd Thomas Timmons by their attorneys afd and the Said Thomas Timmons by his Said attorney Sayth that he Cannot gainsay the afd Blandina her action afd so as afd against him brought nor ^Can he say^ but that the said Blandina Ought to recover her damages by Occasion of the premisses afd to Eight hundred & fifty pounds of tobacco and Costs of Suite against him which the said Blandina doth not gainsay Therefore it is Considered by the Justices here the same day & Year Last mentioned that the afd Blandina Bozman Recover against the afd Thomas Timmons as well the Sum of Eight hundred & fifty pounds of tobo her damages by occasion of the premisses afd in form afd Confessed as also the Sume of three hundred & Twenty Two (322) pounds of tobacco by the Court here adjudged unto her for her Costs and Charges by her about her suite in this behalfe Laid out & Expended & the afd Thomas Timmons in Mercy &c |
