 Lazarus Maddux of Somersett County Gentl al dict Lazarus
Maddux of Somersett County in the Province of Maryland Gentl was
sumoned to answer unto Robert Macomb of a Plea of Trespass
that he render unto him the Just ^& full^ Sum of Nine hundred ^& thirty^ pounds of good
and every way well Quallified Tobacco in Casque which to him he Owes and unjustly Detaines &c
And whereupon the same Robert by Levin Gale his attorney saith That whereas the afd
Lazarus the Tenth day of May seventeen Hundred and Twenty Two at the County afd within the
Jur of this Court By his Certain Bill with^ch^ the same Robert hereinto Court brings Bound himselfe
himself unto the afd Robert fifteen Hundred pounds of Tobacco when afterwards
he should be thereto requested Nevertheless the afd Lazarus although he five hundred
and seventy Pounds ^of^ Tobacco part of the afd fifteen hundred pounds of Tob &
to the same Robert Hath rendered yet he the sum of Nine hundred and Thirty pounds
of Tobacco the residue of the sum ofifteen hundred pounds of Tobacco to the same
Robert Hath not rendered (altough Often Thereto required) but the same
Lazarus the said sum of Nine hundred and Thirty pounds of Tobacco the residue
as afd ^to^ the same Robert hitherto to render hath altogether deny'd & still doth
Deny whereby the same Robert says he is worse & hath damage to the Value
of Eighteen hundred pounds of Tobacco and Thereof he Brings this suite &c

And the said Lazarus Maddux by Francis Allen his attorny Cometh and Defendeth the
fource and Injury when &c and prayeth Leave to Imparle hereunto untill the Next Court
and he hath it & the same day is Given to the afd Robert Macomb also
Att which said Next Court to witt the sixteenth day of March Ann Dom one thousand seven
Hundred and Twenty four Came again as will the afd Robert Macomb as the afd
Lazarus Maddux by their attorneys afd and the same attorney saith that he is not Informed by the
same Lazarus Maddux (his Clyant) of any answer by the same Lazarus to the afd Robert Macomb in
the plea afd to be given and nothing Else thereof Saith whereby the Same Robert Remains against the afd
Lazarus thereof undefended &c       Therefore it is Considered by the Court here the same day and year
Last mention'd that the afd Robert Macomb recover against the afd Lazarus Maddux as well the Sum of Nine hundred
(930)   & thirty pounds of tobacco his debt afd as also the Sum of Two hundred and fifty Nine pounds of tobacco by the Court here
adjudged unto him for his Costs and damages Sustained by Occasion of the detaineing of the same debt and the afd
Lazarus Maddux in Mercy &c
