(7) Twelveth day of september One thousand seven hundred & Twenty four & Often afterwards Hath not paid But he hitherto to pay it hath altogether refused and still doth refuse whereby he says he is ^the^ worse and hath Damage to the Value of Two thousand four hundred pounds of tobacco and Thereupon he Brings This suite &c Dashiell pro Qurte pledgs John Doe Richd Roe Aprill 20th Capt Joseph Vennables 1724 To 1 silver Mounted Sworn 12 hundred wt Tobacco Payable on Demand 1200 Somersett County Septr 20.th 1724 Errors Executed per me John Carruthers And the said Joseph Vennables by Levin Gale his attorney Cometh and Defendeth the fource and Injury when &c and prayeth Leve to Imparle hereunto untill the next Court and he hath that and the same day is given to the afd John Carruthers also Att which said Next Court to witt the sixteenth day of March Anno Dom One thousand seven hundred and Twenty four Came again as well the afd John Carruthers as the afd Joseph Venables by their attorny's afd And the same attorny saith that he is now Informed by the same Joseph Vennables his Clyant of any answer for the same Joseph to the afd John Carruthers in the plea afd to be Given and Nothing Else Thereof Saith By that the Same John Carruthers Remains againest the afd Joseph Vennables Thereof undefended &c for that the same John Carruther his damages by Occasion of the Premisses against the afd Joseph Venables Ought to recover; but because it is unknown what damages the afd John Carruthers hath sustained by Occasion of the premisses afd the Justices at the prayer of the afd John Carruthers and by the Consent of the afd Joseph Venables according to act of assembly in Such Case made & provided are to Enquire into the damages of the af John Carruther by Occasion of the premisses afd which Justices thereupon say that the Said John Carruther hath sustained noe damage by means of the premises afd &c Therefore it is Considered by the Court here the same day & Year Last mentioned that The said John Carruthers take nothing by his declaration afd but be in mercy for his falce Clamour & that the said Joseph Venables goe thereof without day also it is Considered by the Court here that the Said Joseph Venables Recover against the said John Carruthers the Sume of pounds One hundred & 156 fifty six pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him about his defence in that part Expended according to the form of the Statute &c
