74 appear (as Garnishe) before the Justices within Named to Shew Caus why the Same Should not be Condemned for the Use of mary Martin as by the within Writt I am Commanded so answers Fra Allen Sher Whereupon the said Thomas Gillis Garnishe as afd altho' Solemnly Called to Shew Cause &c Comes not but makes default nor does any other person appear for him to Shew Cause to the Contrary &c Whereupon the afd Mary Martin by her attorney afd prays that Nine hundred and Twenty One pounds of tobacco part of the Sum afd attached as of the Rights and Creditts of the Said Jonathan Raymond may be Condemned in the hands of the Said Thomas Gillis towards satisfying unto the said Mary Martin as well her Damages & Costs Recovered against the Said Jonathan Raymond as also the Costs accrewing upon the writt of attachmt afd Therefore it is Considered by the Justices here the sixteenth day of Novr ann.o Dom One thousand seven hundred and twenty five afd that the Said sum of Nine hundred and Twenty one pounds of tobacco part of the Sum so as afd attached be Condemned in the hands of the Said Thomas Gillis as of the Rights and Creditts of the Said Jonathan Raymond towards satisfying unto the said Mary Martin Exeutrix as afd ^as^ well ^her^ Certain Damages and Costs recovered against the Said Jonathan Raymond as also all Costs accruing upon the writt of attachm.t afd to act of assembly &c
whereas a Certain Robert Martin Lately in Our County Court of Somersett to witt on the Eighteenth day of June in ye Eight Year of Our Dominion &c ann Dom one thousand seven hundred and twenty three before ye Worshipfull Charles Ballard Gent & his associated then Justices of our Said Court (at Dividing Creek) & by Consideration of our same Court recovered against a certain George Hutchins of Stepny Parish in Somersett County Planter as well the sum of one thousand six hundred & fifty Six pounds of tobacco Certain Damages as also the Sum of two hundred & forty two pounds of tobacco which to ye same Robert Martin in our said Court were adjudged for his Costs & Charges by him about his suite Laid out & Expended Whereof he is Convict as by ye Record & process hereof in our Said Court before our Justices at Dividing Creek now remaining manifestly appeareth Nevertheless Execution of the Judgmt afd as yett remaines to be done & ye afd Robert Martin is since dead as by the Insinuation of Mary Martin relect & Exrx of ye Last will & testament of ye afd Robert Martin we have rec.d & because we will that those things which in Our Said Court are rightly done should be brought to a due Execution We Command you that by Good & Lawfull men of your bailywick you (make) |
