Make Known unto ye afd George Hutchins that he be & appear before ye Our Justices of Our County
Court to be held at Dividing Creek in Somersett County afd the third tuesday of Novem Next to
Shew Cause if any thing for himselfe he hath or Knoweth to say why the afd Mary Martin Exrx
as afd should not have her Execution against him for ye damages & Costs afd according to ye form of
the recover afd she Ought not to have if to him it shall seem Expedient & have you then & there the
Names of those by whom you make ye Same Known & this Writt Wittness Samuel Hopkins Gent Chiefe
Justice of our Said Court ye Nineteenth day of august in ye tenth year of Our Dominion &c anno Dom
1725         Att which said third tuesday of Novem to Witt the Sixteenth day of Novem ^the same Month^ anno Dom One thousand
Seven hundred and Twenty five being the day of the Return of the Said Writt Cometh the Said Mary Martin Exrx as
afd by her attorney afd and the Sherr of Somersett County to whom the foregoing Writt was directed Likewise Cometh
and maketh return thereof to the Court here Endorsed in these words vizt Made Known p Fran Allen Sher

          Whereupon the afd Mary Martin by her said attorney prayeth that the Said George Hutchins to
her writt of Scire facias afd may answer but the said George Hutchins altho' Solemnly Called Cometh not nor Sheweth
Cause why &c but maketh defaut whereby the Said Plft Remain^eth^ against the afd deft thereof wholly
undefended &c       Therefore it is Considered by the Justices here the same day and Year Last mentioned
that the afd Mary Martin Exrx of the Same Robert Martin have Execution against the said George Hutchins
of the Judgm.t afd as well for the Sum of One thousand Six hundred and fifty Six pounds of tobo Certain
Damages as also the Sum of two hundred and forty two pounds of tobacco Costs of suite in the Judgm.t afd specifyed
(258)   as also for the Sum of Two hundred and fifty Eight                           pounds of tobacco by the
Court here adjudged unto him for his Costs and damages sustained by Occasion of Delay of Execution of ye
Judgm.t afd &c

 Command was given to the Sherr of Somersett County that he Should Take
Robert Givan Late of Somersett County Planter if he should be found in his bailywick
and him Should Safe Keep so that he Should have his Body Before
                           the Justices of his Lordships County Court of Somersett to be held at Dividing Creek the
third tuesday of Novem then next to answer unto William Ennalls of a plea of trespass upon the Case &c
and that thereof he Should not fail &c

          And the said William Ennalls by Levin Gale his attorney declared against the said Robert Givan in the
plea afd as followeth viz.t   Somersett County fs  Robert Givan Late of Somersett County planter was attached
to answer unto William Ennalls of a plea of trespass upon the Case &c

          And whereupon the said William by Levin Gale his attorney Complaines that whereas the Said
Robert the twenty Sixth day of march anno Dom One thousand Seven hundred and twenty four at the
County afd within the Jurisdiction of this Court was Indebted unto the Said William in the Sum of thirteen
hundred and sixty nine pounds of tobacco as by an acco.t thereof hereunto annexed may in Court appear
and being so thereof Indebted the said Robert in Consideration thereof afterwards to witt the day
and year afd at the place afd in Consideration thereof upon himselfe did assume and to the same Willm
