Concerning his begetting a bastard Child of the Body of a Certain Rachell Porter &c Whereupon the said Alexander Maddox together with Thomas Maddox of Somersett County Planter his security present in Court in their proper persons acknowledged themselves to Owe & Stand Justly Indebted Joyntly and Severally unto his Lordship the Lord proprietary his heirs & successors that is to say the said Alexander Maddox in thirty pounds Sterr and the Said Tho.s Maddox in thirty pounds ^ster^ severally on their Bodys goods or Chattells Lands or Tenements for the Use of his said Lordship the Lord proprietary his heirs and successors ^to be Levied^ In Case the said Alexander Maddox do not make his personall appearance before the Justices of his Lordship County Court of Somersett at Dividing Creek the third tuesday of march next to answer unto his said Lordship Concerning the premisses afd and to Stand and abide the Judgm.t of the Court thereupon and not to depart the Same Court without Lycence thereof &c Sarah Hogg and Eliz.a More being bound by Recognizance for their appearance this Court to give Evidence against John Lathbury; appears and are accordingly discharged &c Jn.o Lathbury appears according to his Recognizance Entered into for his appearance this Court &c and is discharged &c John Caldwell Jun.r and Thomas Caldwell being bound by the Court for their good behaviour (& appearance at this Court) toward the Indians &c appears & are discharged &c
Thomas Timons Lately in Our County Court of Somersett to witt ^on^ the twentieth Day of August in the Eight Year of Our Dominion &c Anno Dominion One Thousand Seven Hundred & twenty four before the worshipfull Charles Ballard and his associates then Justices of Our Said Court at Dividing Creek and by Consideration of Our Said Court Recovered against a Certain Jn.o Layton of Stepney Parish in Somersett County Planter as well the Sum of five Hundred Pounds of Tobacco and fifteen Bushells of Indian Corn Certain Damages as also the Sum of Two hundred & forty Pounds of Tobacco for his Costs & Charges by him about his Suite in this Beha^l^fe Laid out & Expended Whereof he is Convict as by the Record & Process thereof in Our Said Court Remaining Manifestly Appears & for as Much as Execution Remaineth thereupon as yet to be done (as by the Insinuation of the Said Thomas Timmons we have rec.d) and because we will y.t those things which in Our Said Court are Rightly Done & Acknowledged Should be Brought to a due Execution We Command you that ^that by good & Lawfull men of your Bailywick^ You Make Known unto the Said John Layton that he be &^ appear before the Justices of Our County Court to be Held at Dividing Creek in Somersett County afd the Third Tuesday of November Next to Shew Cause if any for himselfe he Hath or Knoweth to say why the Said Thomas Timmons his Execution (of) |
