of the Judgment afd According to the Acknowledg.mt & form of the recovery afd he ought not ot have if
to Himself it Shall Seem Mete & have you Then & there the Names of those by which whom you
Make ye Same Known & this Writt Witness Samuell Hopkins Gent Chiefe Justice of our s.d Court
the 19th day of August in the tenth Year of Our Dominion &c    Ann Dom 1725

          Att which said third tuesday of November to witt the Sixteenth day of the Same month ann.o
Dom One thousand Seven hundred and twenty five being the day of the Return of the Said
Writt Cometh the said Thomas Timons by his attorney afd and the Sherr of Somersett County to
whom the foregoeing Writt was directed Likewise Cometh & maketh Return thereof to the Court
here Endorsed in these words following Viz.t made Known p Francis Allen Sherr

       Whereupon the afd Thomas Timons by his attorney afd prays that the afd John Layton to his Scire
facias afd may Answer but the Said John Layton altho' Solemnly Called Cometh not Nor Shews Cause
why &c but makes default &c whereby the Said plft Remains against the afd deft thereof
wholly undefended &c

                Therefore it is Considered by the Justices here the Sixteenth day of Novem anno Dom
One thousand Seven hundred and twenty five afd that the afd Thomas Timmons have Execution ag.t
the afd Edward Hug John Layton of the Judgm.t afd as well for the Sum of Five hundred pounds of
tobacco and Fifteen Bushells of Indian Corn Certain Damages as also the Sum of two hundred and
forty pounds of tobacco Costs of Suite in the Judgm.t afd Specifyed as also the Sum of Two hundred
(257)   and fifty Seven                     pounds of tobacco by the Court here adjudged unto him for his Costs &
Damages sustained by Occasion of Delay of Execution of the Judgment afd &c

 This being an action of Trespass upon the Case &c wherein the Sherr of Somersett County

to whom the writt in the Same action was directed Comes and makes Return thereof
                               Endorsed in these words following vizt      Cepi Corpus P Francis Allen Sherr
       Whereupon the Said Alexander Maddox being Called appears and thereupon the Said Alexander
       Maddox at the prayer of the plfts attorney is adjudged to give Speciall Bail to the action afd
       whereupon a Certain Thomas Maddox of Somersett County Planter present in Court because Special
       Bail to ye action afd for the Said Alexander Maddox &c

Exrx of the Last will and testament of Robert Martin dec.d of a plea that

        he Render unto her the Sum of three thousand ^one hundred & sixty^ pounds of tobacco which from her he unjustly
       detaines &c    And whereupon the Same Mary by Levin Gale her attorney saith that whereas the
       afd Robert John the Eighteenth day of June Seventeen hundred and twenty four at the County
