(6) Prayed further ^prayed^ Leave to Imparle hereunto untill the Next Court and he hath it and the same day is Given to the afd Levin Jones ^Ex.r as afd^ also Att which said Next Court to witt the seventeenth day of November Ann Dom One thousand and seven hundred and Twenty four Came again as well the afd Levin Jones ^Executor as afd^ by his attorney afd as the said Tobias Burk in his Own proper pson And Thereupon the Said Tobias Burk Prayed further Leave to Imparle hereunto untill the Next Court & he hath it and the same Day is given to the afd Lewis JOnes ^Executor as afd^ also Att which said Next Court to witt the Sixteenth day of March Ann Dom One thousand seven hundred and Twenty four Came again as well the afd Lewis Jones ^Executor as afd^ by his attorny afd and prayed that the afd Tobias Burke to his declaration in the plea afd may answer but the afd Tobias Burke altho' Solemnly Called Came not nor nothing Saith in bar or preclution of the action afd of the afd Lewis Jones Executor as aforesaid by that the Same Lewis Remains against the afd Tobias thereof undefended &c Therefore it is Considered by the Court here the Same day & Year Last mentioned that the afd Lewis Jones Executor of the same Samuel Jones Recover against the afd Tobias Burke as well the sume of five hundred pounds of tobo his debt afd as also the sum of (302) three hundred & Two Pounds of tobacco for his damages which he Sustained ^as well^ by occasion of the detention of that same debt as for his Costs and Charges by him about his suite in that part opposed ^to^ the same Lewis Jones Executor as afd by the Court hereof his assent adjudged & the afd Tobias in Mercy &c
and Unjustly Detaines &c And whereup^on^ the same Francis ^Mercer^ by Levin Gale his Attorny saith That whereas the afd Robert Martin the twentieth day of October seventeen hundred and Nineteen at the County afd within the Jurisdiction of This Court By his Certain writing Obligatory Granted himself to be held and firmly Bound unto the afd Francis in the full and Just sum of One hundred pounds Currant mony of Maryland to be paid the Same Francis when thereunto afterwards the afd Robert should be requested Yett the afd Robert the afd sume of One hundred pounds Currant mony as afd Or any Part thereof to the SAme Francis hath not rendered although often Thereunto Requested but the afd Robert the same hitherto to the same Francis to render hath altogether Denyed and still Doth Deny and Unjustly Detain whereby the same Francis says he is worse and hath damage to Value of Two hundred pounds Currant mony as afd and Thereof he Brings this Suite &c and the same Francis Brings hereinto Court the writing Obligatory afd wch &c L Gale P Qure pledgs &c John Doe Richd Roe |
