(6) the Truth in the Premisses upon their Oath do say that the said Thomas Robins did not assume upon himselfe in manner and form as the afd John White above against him hath Complained Therefore it is Considered by the Court here the sixteenth day of march Ann Dom One thousand seven hundred twenty four that the said John White take Nothing by his writt & declaration afd but be in mercy for his falce Clamour and that the said Thomas Robins Goe thereof without day Also it is Considered by the Justices here that the afd Thomas Robins Recover against the afd John White One thousand & (1039) thirty Nine pounds of tobacco by discretion of the Justices here at his Request for his 1039 Costs and Charges in that part sustained according to the form of the Statute by the Court here adjudged &c
of five hundred pounds of good sound merchantable Leave tobacco and Casque which from him he unjustly detaines &c And whereupon the same Lewis by Levin Gale his attorney saith that whereas the afd Tobias the first day of June seventeen hundred and Eighteen at the County afd within the Jur of this Court By his Certain Bill with the same Lewis with the seal of the same Tobias Signed here Into Court Brings whose date is the same day and year afd Bound himselfe to pay unto afd Samuel In his Lifetime the afd Sum of five hundred pounds of Good Sound Merchantable Leaf Tobacco and Cask upon the Tenth day of November Next Ensuing the Date of the afd Bill Nevertheless the afd Tobias the afd sum of five hundred pounds of Tobacco or any Part Thereof to the same Samuel in his Lifetime or to the said Lewis since the death of the same Samuel hath not Rendered although often there to do Requested but the same Tobias the said sum of five Hundred pounds of Tobacco and Cask hither to to render hath altogether Denyed & Still Doth deny where by the same Lewis saith he is worse and hath Damage to the Value of Eight hundred pounds of Tobacco and Thereof he Brings &c and the said Lewis Brings Hereinto Court the Letters Testamentary &c By w.ch &c L Gale P Quer pledgs &c John Doe Richd Roe And the afd Tobias Burk in his Own proper pson his attorney Comes and Defends the force and Injury when &c And pray's Leave to Imparle hereunto untill the Next Court & he hath It and the same day is Given to the afd Lewis Jones also Att which said Next Court to witt the Eighteenth day of August Ann Dom One thousand seven hundred & Twenty four Came again as well the ^same^ afd Lewis Jones ^Exr was afd by his attorney afd^ as the afd Tobias Burk in his own proper pson And ^thereupon^ the Said Tobias Burk |
