64 same month ann.o Dom One thousand seven hundred & twenty five being the day of the Return of the said Writt Cometh the said John Laws by his attorney and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and Maketh Return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus p Jos: MccClester Sherr Whereupon the said Charles Ramsey in his own proper person appears and thereupon the said Charles Ramsey at the prayer of the plfts attorney is adjudged to give Speciall Bayle to the action afd Whereupon a Certain Barnett Ramsey and William Merrell both of Somersett County Planters present here in Court undertakes for the said Charles Ramsey that if in Case the said John Laws shall Recover Judgm.t in the plea afd against the said Charles Ramsey or that the said Charles Ramsey shall be therein Convict that then he the said Charles Ramsey shall pay the Condemnation of the Court thereupon or Render his body to the Custody of the Sherr of Somersett County in satisfaction thereof or that they the said Barnett Ramsey and William Merrell will do it for him And the said Charles Ramsey in his Own proper person Comes and defends the force and Injury when &c and says that he Cannot gainsay the plft his action afd against him brought nor Can he say but that the writing obligatory afd is his act and deed and that the debt therein Mentioned is yett due and unsatisfyed wherefore the said plft prays Judgm.t for his debt afd and his Costs and damages sustained by Occasion of the detaining of that same debt to him to be adjudged &c Therefore it is Considered by the Justices here the seventeenth day of august anno Dom One thousand seven hundred and twenty five that the afd John Laws Recover against the afd Charles Ramsey as well the sum of sixty pounds Curr.t money of maryland his debt afd as also the sum of three 377 hundred & seventy seven pounds of tobacco for his Costs and damages sustained by occasion of the detaining that same debt to the same John Laws of his assent by the Court here adjudged & the afd deft in mercy &c
of his Lordships County Court of Somersett to be held at dividing Creek the third tuesday of June ^then^ Next to answer unto Marke Scott of the said County of a plea that he Render unto him the sum of seven hundred pence which to him he Owes and from him he unjustly detaines &c and that thereof he should not faile &c Att which said third tuesday of June to witt the fifteenth day of the same month anno Dom One thousand seven hundred and twenty five being the day of the Return of the said Writt Cometh the said Marke Scott by George Dashiell his attorney and the Sherr of Somersett Coty (to) |
