might have his body Before the Justices of his Lordships County Court of Somersett to be held at dividing Creek the third tuesday of August then next to answer unto Francis Graden of a plea that he Render unto him the full and Just Sum of two thousand four hundred pounds of good Sound Merchantable tobacco in Cask which to him he Owes and Unjustly detains &c and that thereof he Should not fail &c Att which said third tuesday of August to witt the Seventeenth day of the Same month ann Domo One thousand Seven hundred & twenty five being the day of the Return of the Said Writt Cometh the said Francis Graden by Levin Gale his attorney and the Sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt Cepi Corpus P Jos: MccClester Sherr And the said William Jones in his Own proper person Cometh and defendeth the force and Injury when &c and says that he Cannot gainsay the plft his action afd against him brought nor Can he Say but that the writing Obligatory afd is his act and deed and that the debt therein Mentioned is yett due and unsatisfyed wherefore the said plft prays Judgm.t for his debt afd and his Costs and damages sustained by Occasion of the detaining that Same debt to him to be adjudged &c Therefore it is Considered by the Court here the Same day and Year Last Mentioned that the afd Mary Ma Exrx as afd ^Francis Graden^ Recover against the afd William Jones as well the Sum of two thousand four 307 hundred pounds of tobo his debt afd as also the sum of three hundred and seven pounds of tobo for his Costs and damages Sustained by Occasion of the detaining that Same Debt to the same Francis Graden of his assent by the Court here adjudged & the afd deft in Mercy &c
Safe Keep so that he should have his body before the Justices of his Lordships County Court of Somersett to be held at dividing Creek the third tuesday of August next to answer unto John Laws of the said County of a plea that he Render unto him the penall Sum of sixty pounds Currt mony of maryland which to him he Owes and from him he unjustly detains &c and that thereof he should not fail &c Att which said third tuesday of august to witt the seventeenth day of the (same) |
