63 the of June and the tenth day of June seventeen hundred and twenty four at the County afd within the Jurisdiction of this Court was Indebted unto the afd Robert in his Life time in the sum of five hundred and two pounds of tobacco ^as^ by an acco.t doth appear and so thereof being Indebted the said Jonathan in Consideration thereof afterwards to witt the day and year afd in the County afd within the Jurisdiction afd upon himselfe assumed and to the same Robert in his Lifetime then and there faithfully promised that he when afterwards he should be thereunto Required the afd sum of five hundred & two pounds of tobacco to the same Robert he would well and faithfully pay and Content Nevertheless the afd Jonathan his promise and assumption afd in form afd made Little Regarding but plotting and fraudulently Intending the afd Robert in his Lifetime and the afd Mary since the death of the same Robert in that part to defraud & deceive he the ^said^ sum of five hundred and two pounds of tobacco or any part thereof to the same Robert in his Lifetime or the afd Mary since his death hath not paid nor Either of them for it in anyways Contented altho' the same to doe afterwards by the same Robert in his Lifetime the day and year above and by the same Mary since the death of the said Robert the twentyeth day of June seventeen hundred & twenty five at the County afd within the Jurisdiction afd was Requested but the said Jonathan the same hitherto to do hath altogether Refused and Still doth Refuse whereby the same Mary says she is worse and hath damage to the value of one thousand pounds of tobo and thereof she brings this suite &c and ye same Mary Brings here into Court the Letters testamentary &c by which &c L Gale P Quer Pledges &c Jno Doe R Roe Att which said third tuesday of August to witt the seventeenth day of the Same month anno Dom one thousand seven hundred and twenty five being the day of the Return of the said Writt Cometh the said Mary Martin Executrix as afd by her attorney afd and the Sherr of Somersett County to whom the foregoeing writt was directed ^likewise^ Cometh and make Return thereof to the Court here Endorsed in these words following vizt Non Est Inventus p Jos: MccClester Sher Whereupon the said Mary Martin Executrix as afd by her attorney afd prays that forasmuch as She hath Complyed with the Law in order to an attachm.t she may have Judgmt against the said Jonathan Raymond for her damages afd by way of attachm.t according to act of assembly &c thereupon for that it seemeth to the Court here that the said Mary Martin Executrix as afd hath Complyed with the Law as alledged Therefore it is Considered by the Court here the seventeenth day of Augt anno Dom One thousand seven hundred and twenty five that the afd Mary Martin Executrix as afd Recover against the afd Jonathan Raymond as well the sum of five hundred & two pounds of tobo her damages (221) by Occasion of the premisses afd as also all Costs and Charges laid Laid Out and Expended about her suite by way of attachm.t against ye goods Chattells Rights or Creditts of the said Jonathan Raymond according to act of assembly in such Case made and provided &c |
