63 afd to the same Robert Martin in his Lifetime or to the afd Mary Since the death of the afd Robert hath not Rendered but the Said Michael the Same hitherto to the Same Mary to Render hath denyed and still doth deny and unjustly detain whereby the Said Mary says she is worse and hath damage to the value of forty pounds Curr.t money afd and thereof she brings Suite &c and the same Mary brings hereinto Court as well the Letters Testamentary afd as the writing Obligatory afd &c L Gale P Quer Pledges &c Jno Doe R Roe Att which said third tuesday of August to witt the Seventeenth day of ^the^ same month anno Dom one thousand Seven hundred & twenty five being the day of the Return of the Same Writt Cometh the said Mary Martin Executrix as afd by her attorney afd and the Sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh Return thereof to the Court here Endoresed in thes words following vizt Non Est Inventus P Jos: MccClester Sherr Whereupon the said Mary Martin Executrix as afd by her attorney prays that forasmuch as she hath Complyed with the Law as alledged in order to an attachm.t she may have Judgm.t against the said Michael Holland for her debt afd by way of attachm.t according to act of assembly &c whereupon for that it Seemeth to the Court here that the Said Mary Martin Exrx as afd hath Complyed with the Law as alledged Therefore it is Considered by the Court here the Seventeenth day of August anno Dom One thousand Seven hundred & twenty five that the afd Mary Martin Exrx as afd Recover against the afd Michael Holland as well the sum of thirty two pound Curr.t ^money her debt^ afd as also all Costs and damages sustained by Occasion of the detaining the same debt to be recovered by way of attachment against the goods Chattells Rights or Creditts of the Said Michael Holland according to act (331) of assembly in Such Case made and provided &c
