    August Court               1725                        62

          Tobias Burke at the prayer of the Plfts attorney afd is adjudged to give Speciall bayle to the action
    afd thereupon a Certain Richard Tiler of Somersett County Gent Present here in Court undertakes for
    the said Tobias Burke that in Case the said Mary Martin Exrx as afd shall Recover Judgm.t in the plea
    afd against the Said Tobias Burke or that the Said Tobias Burke shall be therein Convict that then he the
    Said Tobias Burke shall pay the Condemnation of the Court thereupon or Render his body to the Custody
    of the Sherr of Sommersett in Satisfaction thereof or that he the said Richard Tiler will do it for him
   
          Whereupon the afd Tobias Burke in his Own proper person Comes and defends the force and Injury
    when &c and says that he Cannot gainsay the plft his action afd against him brought nor Can he Say
    but that the writing Obligatory afd is his act and deed & that the debt therein Mentioned is yett due and
    unsatisfyed wherefore the said plft prays Judgm.t for his debt afd and his Costs and damages
    sustained by Occasion of the detaining of the Same debt to him to be adjudged &c

                   therefore it is Considered by the Court here the Seventeenth day of aug.t ann Dom One
    thousand seven hundred & twenty five that the afd Mary Martin Executrix as afd Recover against the
    afd Tobias Burke as well the sum of thirteen hundred & forty six pounds of tobacco her debt afd
289   as also the sum of two hundred and Eighty nine               pounds of tobacco for her Costs and damages
    sustained by occasion of the detaining of the same debt to the same Mary Martin Exrx as afd of her
    assent by the Court here adjudged & the afd deft in Mercy &c

     Command was given to the Sherr of Somersett County that he Should Take
William Pepper of alhollows Parish in the County afd Planter if he Shall be found
          in your his Bayliwick and him should Safe Keep so that he might have his body Before the
       Justices of his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday
       of August then Next to answer unto ^Mary^ Martin Executrix of the Last will and testament of Rob.t
       Martin Late of Somersett County dec.d of a plea that he Render unto her fifteen hundred and Nineteen
       pounds of tobacco which from her he unjustly detains &c  And that thereof he Should not
       fail &c                Att which said third tuesday of August to witt the seventeenth day of the same
       month anno Dom One thousand Seven hundred and twenty five being the day of the Return
       of the Said Writt Cometh the Said Mary Martin Executrix as afd by Levin Gale her attorney
       and the Sherr of Somersett County to whom the foregoeing writt was directed ^Likewise^ Cometh and Maketh
       Return thereof Endorsed in these words Endorsed vizt   Cepi Corpus P Jos: MccClester Sher

             Whereupon the said William Pepper at the prayer of the Plfts attorney is adjudged to give
       speciall bail to ye action afd   thereupon Somersett Dickenson of Somersett County Planter present
