to him to Render hath altogether denyed & still doth deny and unjustly detaine whereby the same John
says he is worse and hath damage to the value of fifty pounds Curr.t Money & thereof he brings this
suite &c    L Gale P Quer Pledges &c   Jno Doe   R Roe

and the same Jno Brings here into Court ye writing obligatory afd &c by which &c

          And the afd Merrick Ellis in his Own proper person Comes and defends the force & Injury
when &c and says that he Cannot gainsay the plft his action afd against him brought nor Can he Say but
that the writing obligatory afd is his act and deed and that the debt therein Mentioned is yett due & unsatisfyed
wherefore the Said plft prays Judgm.t for the debt afd and his Costs and damages sustained
by Occasion of the detaining of the same debt &c

                                          Therefore it is Considered by the Court here that seventeenth day of august
Ann.o Dom One thousand Seven hundred & twenty five that the afd John Jordan Recover against the said
Merrick Ellis as well the Sum of forty five pounds Curr.t money of Maryland his debt afd as also the sum
(290)   of Two hundred and ninty                     pounds of tobacco for his Costs and damages sustained by
Occasion of the detaining of the Same debt to the Same Plft by his assent by the Court here adjudged &
the afd Deft in mercy &c

Mary Martin Executrix of the Last will and Testament of Robert Martin dec.d
                   of a plea that he render unto her thirteen hundred & forty six pounds of tobacco which from her
he unjustly detains &c                   And whereupon the same Mary by Levin Gale her attorney Complaines
that whereas the afd Tobias the seventh^eenth^ day of June ann.o Dom seventeen hundred and twenty four at
Somersett County afd within the Jurisdiction of this Court by his Certain Writing Obligatory granted
himselfe to be held and firmly bound unto the afd Robert Martin in his Lifetime in the penall Sum of
thirteen hundred and forty Six pounds of tobacco to be paid the Said Robert Martin his heirs Executors
adm.rs or assignes when afterwards the said Tobias should be thereto Required Nevertheless the Said
Tobias tho' often thereto Required the afd Sum of thirteen hundred and forty six pounds of tobacco to the
same Robert Martin in his Lifetime or to the afd Mary since the death of the Same Robert hath not
Rendered but the said Tobias the same hitherto to the same Mary to Render hath denyed and still doth
deny and unjustly detain whereby the said Mary says she is worse and hath damage to the value of two
thousand pounds of tobacco and thereof she brings suite &c and the Same Mary brings here into Court as
well the Letters testamentary afd as the writing obligatory afd &c    L Gale P Qur Pledges &c Jno Doe R Roe

          Whereupon the said Tobias Burke in his Own proper person appears & thereupon the said
