60 to witt the seventeenth day of November ann.o Dom one thousand seven hundred and twenty four Came again as well the afd Jeffry Flower as the afd Thomas Billin by their attorneys afd and thereupon the Said Thomas prayed further Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd Plft also Att which said next Court to witt the Sixteenth day of March anno Dom One thousand seven hundred and twenty four Came againe as well the afd plft as the afd deft by their attorney afd and thereupon the said deft by his Said attorney prayed further Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the ^afd^ plft also Att which said next Court Came to witt the fifteenth day of June ann.o Dom One thousand seven hundred and twenty five Came againe as well the afd Jeffery Flowers as the afd Thomas Billing by their attorneys afd and thereupon the Said Thomas by his said attorney as before defends the force and Injury when &c And says that he did not assume upon himselfe in Manner and form as the afd Jeffery above against him hath Complained and of this he puts himselfe upon the Country &c A the plft Likewise Whereupon the afd Thomas Billin by his attorney afd Relinquisheth his verification afd by him above pleaded and Says that he is not Informed by the Same Thomas Billin his Clyant of any answer for the same Tho.s to the afd Jeffr'y ^in the plea afd^ to be given and Nothing Els thereof says by which the same Jeffr'y Flowers Remains against the afd ^Thos Billin^ thereof undefended Wherefore the afd Jeffr'y Flower his damages by occasion of the Nonperformance of the promise and assumption afd Ought to Recover but because it is not Known to his Lordships Justices ^here^ what damages the afd Jeffr'y Flower hath sustained as well by Occasion of the Nonperformance of the promise and assumption afd as for his Costs and Charges by him about his Suite in that part Expanded therefore Command is to the Sherr that by the Oath of honest & Lawfull men of his Bailywick or County he diligently Inquire what damages the afd Jeffr'y Flower as well by Occasion of the Nonperformance of the promise & assumption afd as for his Costs and Charges by him about his ^suite in that part^ Sustained and the Inquisition which thereof he should take to his Lordships Justices at dividing Creek the third tuesday of august Next under his Seal and the Seals of those by whose Oath he make the Same he Send with this writt thereof to him directed &c and the same day is given to the afd Jeffr'y there also &c Att which said third tuesday of August to witt the Seventeenth day of the Same Month anno Dom One thousand Seven hundred and twenty five before his Lordships Justices at Dividing Creek Cometh the afd Jeffery Flower by his attorney ^afd^ and the Sherr Returned a Certain Inquisition before him taken at the Wading place at the head of Back Creek in Somersett County in Maryland on the tenth day of august One thousand Seven hundred and twenty five by which it appears that the afd Jeffr'y Flower Sustained damages by Occasion of the Nonperformance of the promise and assumption afd besides his Costs and Charges by him about his Suite in that part opposed to the ^value of^ Seventy ^one^ Pounds Seven Shillings and th Ten pence Curr.t money of Maryland for those Costs and Charges to One pounds of tobacco Therefore it is Considered by the Court here (the) |
