And whereupon the Said Jeffery by William Tazewell his attorney Complains that Whereas the afd Thomas the thirtieth day of march anno Dom Seventeen hundred and twenty two at the parish and County afd within the Jurisdiction of this Court was Indebted to the Same Jeffr'y in the sum of thirty pounds Seven Shillings and Nine pence three farthings Curr.t money of Vergenia for divers goods Wares and Merchantdizes by him the same Jeffr'y to the afd Thomas before that time there sold and delivered and being so thereof Indebted he the same Thomas in Consideration thereof upon himselfe assumed and to the same Jeffr'y then and there faithfully promised that he the Same Thomas the afd thirty Pounds seven shillings and Nine pence three farthings Curr.t money as afd when he Should be afterwards thereto Required unto the same Jeffr'y would well and truely Content and Pay and altho' the afd Thomas by the hands of a Certain John Jones Gent hath paid Nine pounds and seven pence Currant money afd part of the Said thirty pounds seven shillings and Nine pence three fartings unto the Same Jeffr'y Yett the Said Thomas his promise and assumption afd as to twenty one pds seven shillings and two pence three farthings Curr.t money afd the Residue of the Said thirty pounds Seven Shillings and Nine pence three farthings not Regarding but Minding and fraudulently Intending him the said Jeffer'y in this part Craftilly and Subtilly to deceive and defraud the afd Twenty One pounds Seven Shillings and Two pence three farthings Curr.t money afd or any part thereof to the Same Jeffery hath not paid altho' so to do the afd Thomas the tenth day of February anno Dom One thousand Seven hundred and twenty three at the parish and County afd within the afd Jurisdiction by the same Jeffr'y hath been Required but the same to him hitherto to pay hath Refused and still doth Refuse to the damage of the same Jeffr'y forty pounds Curr.t money afd and thereof he brings Suite &c Tazewell P Quer Pledges &c Jno Doe R Roe And the said Thomas Billing by Francis Allen his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill Next Court and he hath it and the Same day is given to the afd Plantiffe also Att which Said Next Court to witt the Eighteenth day of august ann Dom One thousand seven hundred and twenty four Came againe as well the afd Plft as the afd deft by their attorneys afd and ^thereupon^ the said deft by his said attorney prayed further Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd Plft also Att which said Next Court (to) |
