59 said James Kelly in his Own proper person defends the force and Injury when &c and says that he Cannot gainsay the plft his action afd so as afd against him brought nor Can he Say but that the Said William Whittington Ought to Recover his damages by occasion of the premisses but because it is not Know to his Lordships Justices what damages the afd William Whittington hath Sustained as well by Occasion of the p Non performance of the promise and assumption afd as for his Costs and Charges by him about his Suite in that Part Expended therefore it is Commanded the Sherr of Somersett County that by the Oath of honest and Lawfull men of his bailywick or County he diligently Inquire what damages the afd William Whittington hath Sustained as ^well^ by Occasion of the Non performance of the promise and assumption afd as for his Costs and Charges by him about his Suite in that part Expended and the Inquisition which thereof he should take to the Justices of Somersett County Court at dividing Creek the third tuesday of Novem Next under his Seall and the seals of those by whose Oath he Should make the same Inquisition he send with this writt thereof to him directed and the same day is give the afd William there also &c June the thirtieth day ann.o Dom One thousand seven hundred and twenty five Pursuant to his Lordships Writt of Election for the Choseing of ^deputies^ Delegates for Somersett County to serve in the Next assembly to be held at the City of annapolis &c the Sherr with M.r Samuel Hopkins, Cap John Jones, and William Stoughton Esqr Justices together with the Clerk of the County afd mett at Dividing Creek at the Court house and made Proclamation thereby giving Notice to all freemen qualifyed to give a vote in an Election to appear at dividing Creek afd on the Twenty seventh day of July Next being the Last tuesday in the Same month On which day Came the afd Sherr with severall of the Justices viz.t Mr Samuel Hopkins, Capt Wm Planner Mr Jno Smith, Mr Jn.o Purnall, Capt John Jones Capt William Fasitt, Will.m Stoughton Esq.r & Mr Jn.o Handy And the Cler of the County Court the writt of Election being Read the severall free holder did vote for & Elect Robert King, Levin Gale, Wm Stoughton, and George Dashiell as Delegates for the County afd &c Ordered by the Court that Robert Harris pay unto Southy Whittington, William Shockley, John Lane and Samuel Stevens the Sum of thirty pounds of tobacco Each for their attendance One day as Evidence Each for the Lord proprietary against him they having made Oath to the Same &c Ordered by the Court that Abigail Keeble pay unto John Lane, Southy Whittington, William Shockley and Samuel Stephens the Sum of thirty pounds of tobacco being due unto Each of them as Evidence attendance One day Each for the Lord proprietary against her they haveing made Oath to the Same &c Ordered by the Court that Ann Vannce pay unto Southy Whittington, William Shockley, John Lane & Samuel Stephens the Sum of thirty pounds of tobacco Each being due unto them for their attendance one day Each for the Lord proprietary against her they having made Oath to the same &c Ordered by the Court that Thomas Hugg pay unto Joseph Wailes the Sum of thirty pounds of tobacco being due unto him for his attendance One day ^as Evidence^ On behalfe of the Lord proprietary ag said Thomas Hugg at suite of the Lord proprietary &c he having made Oath to the same &c |
