Complains That whereas the said Thomas the thirteenth day of August One thousand seven hundred & Twenty Three at Pocomoke hundred within the Jur of this Court was Indebted unto the Said John in ye Sum of Two Barrells of Pork as pr a note under the hand of the Said Thomas (signed) May in Court appear and the Said Thomas being Indebted as afd for and In Consideration afd at the Place afd Did upon himselfe assume and to the said John Then and There Did faithfully Promise that the afd Two Barriells of Pork he would well and faithfully Pay) when thereunto Requested Neverthelesse the Said Thomas his Promisse and assumption afd in form afd Made Little reguarding But Contriveing him the Said John in that part to Deceive hath not paid But the Same to pay hath refused and Still Doth refuse to the Damage of the Said John of four Barrells of Pork and Thereupon he Brings this suite &c Dashiell P Quer Pledgs John Doe Richard Roe And the Said Thomas Robins By Francis Allen his Attorney Comes and Defends the fource and Injury when &c and Prays Leave to Imparle hereunto untill the Next Court and he hath it and the Same day is Given to the afd John White also Att which said Next Court to witt the seventeenth day of November Ann Dom One thousand seven hundred and Twenty four Came again as well the afd John White as the afd Thomas Robins by their attorneys afd and Thereupon the said Thomas Robins prayed further Leave to Imparle hereunto untill the Next Court and he hath it and the Same Day is Given to the afd John White also Att which said Next to witt the sixteenth day of March Ann Dom One thousand seven hundred and Twenty four Came again as well the afd John White as the afd Thomas Robins By their attorneys afd and the Said Thomas Robins by his attorny afd ^and before defends the force & Injury when &c and Says^ Pledges Non assumpsitt p Patrium Francis Allen PG Likewise Dashiell Thereupon Command is given to the Sherr of Somersett County That Immediatly he Cause to Come here Twelve &c by whom &c who neither &c to recognize &c because as well &c of which said Precept the said Sherr to witt Joseph MccClester Gentl Now here at this day to witt ye Same Day and Year Last above Mention'd Makes Returne that he hath here twelve &c as by his Precept he was Commanded and nowhere afterwards to witt the same day and Year Came as well the afd John White as the afd Thomas Robins by their attorneys afd and the Jurors of that Jury Therein Impannelled who Being Called Likewise Came to witt Adam Spence Senr, John Fleming, Peter Frazer, Charles Townsend, Samuel Alexander, Underwood Rencher, Richard Chambers, Robert Mitchell, James Rownd, William Bratten, Thomas Collier, John Caldwell, Jun who being duly Elected Tried and sworne to Say the truth in (the) |
