5 And the said Roger Nicholson Jun.r by Francis Allen his attorney Cometh & defendeth the force and Injury when &c And prayeth Leave to Imparle hereunto untill the next Court and he hath it & the same day is given to the afd John Donelson also Att which said next Court to witt the Eighteenth day of august anno Dom One thousand seven hundred & twenty four Came againe as well the afd John Donalson as the afd Roger Nicholson Jun.r by their attorneys afd and ^thereupon^ the said Roger Nicholson Jun.r prayed further Leave to Imparle hereunto untill the Next Court & he hath it & the same day is given to the afd John Donelson also Att which said Next Court to witt the seventeenth day of Novembr Ann Dom One thousand seven hundred and Twenty four Came again as well the afd John Donelson as the afd Roger Nicholson Jun.r by their attorneys afd and thereupon the said Roger Nicholson Junr prayed further Leave to Imparle hereunto untill the Next Court & he hath it and the Same Day is given to the afd John Donelson also Att which said Next Court to witt the sixteenth day of March Ann Dom One thousand seven hundred and Twenty four Came again as well the afd John Donelson as the afd Roger Nicholson Jun.r by their attorneys afd and the said Roger Nicholson Junr says he is not guilty and putts himselfe upon the Country for tryall F Allen P Deft and ye Plft in Like manner L Gale Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to Recognize &c because as well &c of which said Preceipt the Said Sherr to witt Joseph MccClester Gent Now hereat this day to witt the same day & year Last mentioned makes Return that he hath here twelve &c as by his preceipt he was Commanded. And now hereafterwards to witt the Same day & year Came as well the afd John Donelson as the afd Roger Nicholson Jun.r by their attorneys afd and the Jurors of that Jury therein Impannelled who being Called ^Likewise^ Came to witt Adam Spence Sen.r, John Fleming, Peter Frazer, Charles Townsend, Samuel Alexander, Underwood Renchor, Richard Chambers, Robert Mitchel, James Rownd, William Bratton, William Handy and John Caldwell Jun.r who being duly Elected tryed & sworn to say the truth in the premisses upon their Oath do say that the said Roger Nicholson Jun.r is guilty of the premisses as the afd John Donelson above against him hath Complained and do assess the damages of the afd John by occasion of the premisses ^afd^ besides his Costs and Charges by him about his Suite in that part apposed to thirty five shillings ^Curr.t money^ and for those Costs and Charges to one pounds of tobo Therefore it is Considered by the Court here the Sixteenth day of march ann Dom One thousand seven hundred & twenty four that the afd John Donalson Recover against the afd Roger Nicholson Jun.r as well the Sum of thirty five shillings Curr.t money and one pounds of tobacco his damages afd by the Jurors afd in form afd assessed as also one thousand one hundred and Ninety Nine pounds of tobo for his Costs and Charges (1154) by him about his Suit in that part apposed the same John by the Court here at his Request of Increase adjudged & the afd Roger in Mercy &c |
