mentioned is yet due and unsatisfyed wherefore the said plft prays Judgm.t for his debt afd and
his Costs and Damages sustained by occasion of the detaining of the same debt to him to be adjudged
                   therefore it is Considered by the Court here the seventeenth day of august anno Dom one
thousand seven hundred and twenty five that the afd James Simson Recover against the afd
Henry Alexander as well the Sum of Fourteen pounds sixteen shillings Curr.t money afd his debt
(380)   afd as also the Sum of                                                         pounds of tobacco for his Costs
and damages Sustained by occasion of the detaining the same debt by the Court here adjudged unto the
same Thomas Dashiell James Simson and the afd deft in mercy &c

 Somersett County fs     James Kelley Late of Somersett County Carpenter was attached
to answer unto William Whittington of a plea of trespass upon the Case &c
And whereupon the same William by Levin Gale his attorney Complains that Whereas
the said James the tenth day of may one thousand Seven hundred and twenty four at the County afd
within the Jurisdiction of this Court was Indebted unto the same William Whittington in the sum of
Eighty two pounds ten shilling's Curr.t money of maryland for divers goods ^wares^ Causes and Merchantdizes
to him by the said William before that time sold and delivered and so thereof being Indebted the Said
James in Consideration thereof afterwards to witt the Same day and year afd at the County afd within ye
afd Jurisdiction upon himselfe assumed and to the said William then and there faithfully promised
that he when afterwards he should be thereto Required he the afd Sum of Eighty two pounds ten
Shillings Curr.t money afd to the same William would well and faithfully Content and pay Nevertheless
the Said James his promise and assumption afd in form afd made not Regarding but Plotting and
fraudulently Intending the same William in that part to defraud and deceive the Said James Kelley
the said sum of Eighty two pounds ten Shillings Curr.t money afd or any part thereof hitherto to the
Same William altho' often by the Same William thereto Required afterwards viz.t upon the tenth
day of august in the Year afd at Somersett County afd within the Jurisdiction afd hath not paid or
the same William for it in anywise Contented but the Said James he the same hitherto to pay or the
same William for it any way to Content hath altogether refused and still doth Refuse whereby
the same Will.m says he is worse and hath damage to the value of one hundred pounds Curr.t
money and thereof he brings this Suite &c       L Gale P Qur Pledges &c Jno Doe R Roe

      Whereupon the Said James Kelly in his Own proper person appears and thereupon the Said James
Kelly at the prayer of the plfts attorney afd is adjudged to give Speciall Bail to the action afd but for want
thereof the Said James Kelly is Committed into the Custody of the Sherr of Somersett County thereto remain &c
the said sherr being present took Charge of the said James Kelley accordingly                     Whereupon the
