day of seventeen hundred and twenty five at the County afd within the Jurisdiction of this Court Committed fornication with a Certain person against the peace &c and also ag.t the form of the act of Assembly in such Case made and provided wherefore the same Levin for the Said Lord proprietor prays advisem.t of the Court here in the premisses and due process of Law may Issue &c Levin Gale Cler Indictm.ts Thereupon Command is given to the Sherr of Somersett County that he Should take the said Elizabeth Joyce if &c to answer &c and afterwards in the same Court Comes the Said Elizabeth Joyce in Custody of the Sherr and being sett to the Barr and Information Read pleads guilty and Submits to the Mercy of the Court and makes Oath that a Certain Andrew Thompson is the Begetter of the Child she then stood Informed against for but hath not wherewithall to pay her fine for the fact afd Wherefore it is Considered of by the Court that the said Elizabeth Joyce be whipt with fifteen Lashes at the publick whiping post on the bare Back Well Laid On untill the Blood appear and that she be taken &c and thereupon as to the Corporall Punishm.t afd Command is given to the Sherr of Somersett County that he do thereof Immediate Execution according to the Judgm.t afd Rendered by whiping the afd Elizabeth Joyce at the Publick whiping Post with fifteen Lashes on the Bare Back well Laid on untill the blood appear and afterwards in the Same Court the Sherr Returns that he has done the Execution of the Judgm.t afd as to the Corporall Punishm.t afd he was Commanded &c thereupon the said Elizabeth Joyce is ordered to give security for fees bur for want thereof she is Committed into the Custody of the Sherr of Somersett County thereto remain &c Whereupon the said Sherr by Hugh Porter his deputy present took Charge of the said Elizabeth Joyce accordingly &c Whereupon Its ordered by the Court that Elizabeth Joyce give recognizance in f Twenty pounds Sterr for her appearance at Next Court to give Evidence against a Certain Andrew Thompson thereupon the Said Elizabeth Joyce by acknowledged herselfe to Owe and Stand Justly Indebted unto the Right honrble the Lord Proprietary his heirs and assess successors in twenty pounds Sterr to be Levied on her Body goods and Chattells Lands and tenements for the use of his Said Lordship In Case she doth not make her personall appearance before the Justices of the County Court of Somersett to be held at dividing Creek the third tuesday of Novem Next and give Evidence on behalfe of the said Lord proprietary against ye sd And.w Thompson & not to depart ye same Court without Leave &c |
