51 is Given to the sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who Neither &c to Recognize &c because as well &c of which said preceipt the said sherr to witt Joseph McClester Gent Now hereat to witt the same day & year makes return that he hath here Ready twelve &c as by his said preceipt he was Commanded and the Jury therein Impannelled being Called Likewise Came to witt William Mills, John Townsend sen.r John White Marumsco, George Benston, Robert Hall, Isaac Piper, W.m Piper Christopher Piper, Cannon Winright, Lewis Beard, John Read, Joseph Wailes who being duely Elected tryed and Sworn to say the truth in the premises upon their Oath do say that the afd William Whittington is not guilty of the premises whereof he stands presented &c Wherefore it is Considered by the Justices here that the afd William Whittington of the premisses afd be acquitt &c and goe thereof with out day &c
day of June Seventeen hundred and Twenty four at Somersett County afd within the Jurisdiction of this Court Committed adultery with a Certain Ann Bullingall against the peace and &c and also against the form of the act of assembly in Such Case made and provided wherefore the said Levin for the said Lord proprietary prays advisement of the Court herein the premisses &c L Gale P Dom Pro Thereupon Command was given to the Sherr of Somersett County that he Should take the Said Thomas Hugg if &c to answer &c and now hereafterwards to witt Comes the said Thomas Hugg in Custody of the Sherr of Somersett County into whose Custody before that time was taken for the Cause afd and being by the Sherr Sett to the Barr and Information read pleads not guilty and prays that it may be Enquired of by the Country and Levin Gale who for his Said Lordship in this Behalfe Prosecutes Likewise &c Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who Neither &c to Recognize &c because as well &c of which said Preceipt the Said Sherr to witt Joseph MccClester Gent now here at this day to witt makes return that he hath here Ready twelve &c as by his preceipt he was Command and the Jurors of that Jury therein Impannelled being Called Came to witt John Scarbrough, John Townsend Sen.r John White Marumsco, George Benston, William Mills, Isaac Piper, Giddion Tilman William Piper Christopher Piper Cannon Winright, Lewis Beard and John Reed who being duly Elected tryed & Sworn to say the truth in the premisses upon their Oath do Say that the Said Thomas Hugg is not Guilty of the premisses as by the Information above is Imposed upon him &c Wherefore it is Considered by the Justices here that the afd Thomas Hugg of the premisses afd be (acquited) |
