51 the Court that the Child born of the afd Ann Barton for which she stands presented for is a molatto and whereas there is due to Somersett County Seven Years Service for an Such Inordinate Copulation according to an act of assembly of this province and Likewise the said Child to become a servant for one & thirty years to be disposed of for the use of the County thereupon the said Child is sold by the Court unto James Lindow of Somersett County untill it arrives to thirty one years of age In Consideration ^thereof^ the said James Lindow is to pay unto and for the use of the County afd five hundred and ten pounds of tobacco at the Next Levy Court thereupon the said Ann Barton is ordered home to her masters service and to serve him after the Expiration of her servitude being adj six full months which was adjudged by the Court as full satisfaction for trouble Loss of time & Charge her master was at at the time of her delivery of the Child afd Thereupon it ordered by the Court that the said James Lindow give recognizance in twenty pounds sterr for to return here to the County Court or Sherr of the County at the Expiration of her servitude Whereupon the said James Lindow acknowledged himselfe to Owe and Stand Justly Indebted unto his Lordship the Lord proprietary in the sum of twenty pounds Sterr to be Levied on his Body goods or Chattells Lands or tenements for the use of his said Lordship In Case he doth not deliver her up to the County Court or Sher of the County at the Expiration of her servitude afd &c
thereupon Command was given to the Sherr of Somersett County that he should Cause the afd William Whittington to Come before the Justices of his Lordships County Court to be held at Dividing Creek the third tuesday of August ^yn^ Next to answer unto his Lordship Concerning a Certain presentm.t against him found and that thereof he should not fail &c Att which said third tuesday of August to witt the seventeenth day of the same month ann Dom One thousand seven hundred and twenty three five being the day of the return of the said Writt Cometh the sherr of Somersett County & maketh Return thereof Endorsed in these words following vizt Cepi Corpus p Jos: MccClester Sherr Whereupon the said William Whittington in his own proper person appears and the presentm.t afd being unto him ^Read^ pleads not guilty and he says that it may be Enquired of by the County and Levin Gale who for his said Lordship in this behalfe prosecutes Likewise Thereupon Command (is) |
