4 Horsey as well the sum of forty pounds Curr.t money his debt afd as also the sum of Nine hundred (929) and Twenty Nine pounds of tobo by the Court here adjudged unto him for his Costs and damages sustained by occasion of the detention of the same debt & ye Deft in Mercy &c
attorney Complaines that whereas the same John is a good true faithfull and honest Subject of our Lord the King now and as such a Subject from the time of his Nativity hitherto hath always behaved himselfe and from all fornication Adultrys Bigamy's and fellonys or Such Like Kind of Crimes or Blott altogether five untouched & unattainted hath remained Nevertheless the afd Roger Not Ignorant (of the Premisses or) that the afd John was Married & had Long Before and Every since hath had a wife Residing and Inhabiting in the County afd But of his Mere Malice forethought plotting him the said John in his Good Name fame & reputation to hurt and Make worse and him the said John into Scandall and Infamy amongst his Neighbour's and Other faithfull subjects of Our Lord the King Now unworthily to Endure the tenth day of September Seventeen hundred and Twenty Three at Somersett County afd within the Jur of his Court Haveing Comunication & Speech with Certain Subjects of Our said Lord the King In their psents Did rehearse pronounce and with a high Voice publish there falce feigned scandelous & Malitious and Aprobrious words and Lyes following (vizt) he (the said John Speaking & Meaning) has a wife and Two Children in Barbadoes which Is as Much as to have said the same John has two wifes and further the Said Roger did ^then and there^ pronounce these words in the Presence of sd person vizt I (the same ^Roger^ speaking of himself) do not Value him (the said John again Speaking of and Meaning) for he the said John Meaning) is a Negro finking son of a Bitch which is as Much as to have said that the said John had Carnall Knowledge of Negrores where as the said John Never was Guilty of any such Crimes By reason of the Speaking of which falce Infamous Malitious and Scandalous words the said John is not only In his Good Name fame Credit Estimation & repute afd is Very Much hurt and Damnified But also is Lyable Innocently to Be brought Into Danger of his Life and suffering Corporall Punishment or Being fined and also the same John sundry sums of Mony for the Clearing of his Innocency in that part to Expend whereupon the said John Says he is worse & hath Damage to the Value of Fifty Pounds Curr Mony and thereof he Brings Suit &c Levin Gale P Quer Pledgs &c John Doe Richd Roe (and) |
