4 Nathaniel Horsey by their attorneys afd the said Nathaniel Horsey by his said attorney as before defends the force & Injury when &c says that the afd Amos his action afd against him to have & Maintain Ought not becaus he says that he the said Nathaniel upon the Eleventh day of June seventeen hundred & seventeen at Somersett County afd within the Jurisdiction of this Court paid unto the Same Amos paid two thousand pounds of tobacco in full Satisfaction for the money afd in the Bill afd mentioned which said two thousand pounds of tobacco the said Amos then & there did Receive in full satisfaction for the money afd in the Bill afd mentioned and this the Said Nathaniel is Ready to verifie whereof he prays Judgm.t if the the said Amos his action afd against him to have & maintain Ought &c L Gale P Deft And the afd Amos saith that he by any thing above in pleading alledged from having his action afd against the afd Nathaniel Ought not to be Barred because he saith that the said Nathaniel upon the afd Eleventh day of June seventeen hundred & seventeen did not pay unto the said Amos the afd two thousand pounds of tobacco in full satisfaction for the afd twenty pounds in the bill afd mentioned nor did the said Amos accept of any such sum of tobacco in full satisfaction of the afd twenty pounds as the said Nathaniel above in pleading hath alledged nor did the said Nathaniel pay unto the said Amos the afd twenty pounds in the said Bill mentioned upon the afd Eleventh day of June seventeen hundred & seventeen and this he prays may be Enquired of by the Country &c F Allen P Qur & the deft Likewise L Gale P Deft Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to Recognize &c because as well &c of which said preceipt the said sherr to witt Joseph MccClester Gent Now here at this sixteenth day of march ann Dom One thousand seven hundred & twenty four afd makes Return that he hath here Ready twelve &c as by his said preceipt he was Commanded and now hereafterwards to witt the same day & year Came as well the afd Amos Garrott as the afd Nathaniel Horsey by their attorneys afd and the Jurors of that Jury Impannelled who being Called Came to witt Adam Spence Sen.r, John Fleming, Peter Fraser, Charles Townsend Samuel Alexander, Underwood Rencher, Richard Chambers, Robert Mitchell, James Round, WIlliam Bretton, William Handy, John Caldwell Jun who being duely Elected tryed & sworn to say the truth in the premisses upon their Oath do say that the afd Nathaniel Horsey did not pay in the afd Eleventh day of June seventeen hundred & twenty four unto the afd Amos Garrot the afd two thousand pounds of tob.o in full satisfaction for the afd twenty pounds in the Bill afd mentioned nor did the said Amos accept of the same in full Neither did the afd Nathaniel Pay unto the said Amos the afd twenty pounds in the said Bill Mentioned which on the day & year afd he Ought to have paid Therefore it is Considered by the Court here the sixteenth day of March ann Dom one thousand seven hundred & twenty four that the afd Amos Garrott Recover against the afd Nathaniell |
